A fiber cable was installed on the boundary fence of my property and a shared driveway. Were they suppose to ask for my permission first? As I'm planning to rebuild the fence in the next few years and I don't understand why they wouldn't put it with the other cables underground that run down the driveway.

Yes, if its a shared driveway, they need your permission. You should have the right to get in installed elsewhere if you would have not given consent to the fence installation.

 

What is the LFC/what part of the country are you in.

Not anymore, the process changed a while ago.

 

Chorus will send out a letter explaining the plan. Its then up to you to object to the plan, otherwise its assumed consent is given.

Running the cable underground may not have been an option without having to dig up the driveway. Without knowing the exact situation it's not really possible to comment.

 

Depending on the exact situation they may or may not require your permission to do work in a shared driveway.

Did you get a letter of notification of the proposed work?

 

If not, that would be your starting point to getting this sorted.

No I don't use the driveway as I have my own driveway. But wouldn't I still have rights as the fence is shared and I paid for half?

I may have gotten a letter and had chucked it out without reading it. So I see how that is my fault and has been taken as permission. Is there anything now that I can do to get it removed?

There is not a simple answer to this without knowing a lot more about your property situation and location of the fence. Implied consent changes have also come into play recently as well.

 

There is a process to follow if you're unhappy with what Chorus have done.

If the fence was completely yours and on your property then you might have a few options. Not sure about a shared fence.

 

 

Problem with trying to get it removed is that it's Chorus's property, you'd be liable for damages to it if you do anything to it.

 

 

I'd contact Chorus about getting it moved elsewhere maybe underground, especially if you going to be redoing the fence at some point.

Unless I am missing something but I would have thought routing the fibre via a fence was a silly idea as these are not a long term structures and in the Wellington region subject to a lot of wind.

Attaching fibre to the fence is a category 1 method. This means Chorus has the right by law to do it without asking for your permission. The letter you should have received is simply to informing you of the fact. You don't have any right to object to it. You can talk to Chorus if you like but they aren't obligated to do anything.

It would be a shame if you had to replace some palings and that fibre got damaged in the process..... such a shame.

There are literally thousands of HFC connections on fences as it was an approved Saturn install method when the cable network was first deployed in the '90s and pretty much the standard way of getting a connection to a rear property if an overhead lead-in wasn't possible.

 

I don't recall ever seeing anybody complain about these installs over the years either here on GZ or elsewhere, and yet when Chorus start using the same method many people seem to think the world is ending!
