Be warned, this post is essentially just me having a rant about the perils of right of way fibre installs...

We are renting a house in Hamilton that is down a right of way shared by 6 lots.

The house is brand new and we moved into it in April, thinking that being brand new and in a well built up area (Dinsdale) it should have a full suite of telecommunications options available.

How wrong we were.

The house had no telecommunications services installed at all, despite being a new build and having a brand new concrete driveway.

And so began the painful process of getting consent from each lot on the driveway to get fibre installed. We got everyone to agree except for one retiree, who was concerned about the radiation affects the fibre could have on her health, the possibility of having the driveway ripped up, and this weird obsession with the advantages of copper cables.

Ultimately, discussions broke down and we couldn't obtain her consent. We complained to the landlord and got UFF to get their consents specialist onto her. By November I'd had enough and went to UFF to complain about the whole process, only to find there was a civil design for our driveway waiting to be approved. We approved it instantly, but it did not meet the retirees strict requirements so adjustments needed to be made and by the middle of December we had a date of the 8th of January for our install!!!

Install day came, the UFF guy showed up but civil works had not been completed and he didn't know why. He said he'd talk to his manager about it, did a small amount of internal wiring then left. Today (16 Jan) was the date for our final install but still no civil works have been completed so UFF say the install has been put on hold. The most frustrating thing is that they don't know/won't tell us why the contractor doing the civil work hasn't done it.

By far the most frustrating thing about this entire experience is that the subdivision going in next door got fibre installed (down the same right of way) through a conduit in the concrete. The red fibre is like 10m from our from door. According to UFF, no similar telecommunications conduit runs to our lot...

What a nightmare.

Is it common to have to wait 9+ months for a fibre install??

Sounds like the developer is either a cheapskate or related to the tenant concerned about fibre radiation (FFS), it should rest with him for not installing the correct services under the drive from day one.

Developer is a cheapskate. We’ve been on at the agent at this for months and all we’ve managed to get out of him is a weeks free rent.

We are currently making do with Skinny’s mobile broadband.

Pretty sure ol mate Vodafone offer you a 100gb mobile plan to keep you going or bridge the gap when you sign up or have a fault etc. see how well that works?

My parents just did a subdivision here on the North Shore and made sure fibre was running to all the sections

Cbfd: I believe the civil crew have had machinery break down

From further discussions this evening it sounds like this has indeed been the case, but it would be great if we could get this communicated clearly rather than endless calls backwards and forwards to UFF.

Now it seems the whole thing is on hold until they can get something sorted, but no word on any dates or potential wait times etc.

From what I've been able to work out though, there's no rules against it. Which is absolutely nuts in an area where it has been readily available for years.

What part of dinsdale are you in? Im just off the K drive extension if that helps

And this is why landlords should have to ensure that houses have internet like they have to have power and sanitation services installed into them with no exceptions in urban areas for not having fibre if its available in the street. Cant get fiber? Cant rent the place out.

I've heard of tricky installs taking up to 12 months to complete. This one sounds a bit complicated.

Go to the council and ask to see the property file for your house. (might have to pay a fee to do so). Check all of the resource consents and building consents for your house and the new subdivision. As councils often make it a requirement that telecommunications services are available to each property.

If there is a requirement that fibre is available to the property. Then complain to the council and demand that they enforce the conditions of their consents.

And issue a 14 day notice to fix to the property manager. As there is a clause in the residential tenancies act which says that the landlord must comply with all laws in relation to buildings (may not be exact wording). But the effect is that if the landlord is breaching a condition of a building consent or resource consent, they are also breaching the residential tenancies act.
