My neighbours and I have both recently applied for recently installed fibre in our street. My neighbours power and copper runs from a street pole on my boundary  over my property to their house. 
My copper runs from the street pole  underground through my garden to my house. My drive joins the neighbours to get  out onto the street at the opposite end of the street frontage ie away from the street pole. 
when the neighbour applied for fibre they got chorus preinstall meeting straight away . I applied and its been held up requiring the neighbours consent even though their fibre will run over my property and my new connection wont. The chorus records incorrectly think the connection route runs over  So my application is currently held up  

 

 

 

i emailed chorus with a marked plan from council gis viewer only to be told they wont deal directly with me so i had to send the same to Orcon who just fobbed it off saying chorus will sort out. 
Rather than coming out to site to check it seems my application is in limbo while i wait on the neighbours to give permission for an install that wont even touch their property yet they dont need permission over to run over my property  They are yet to hear anything from Chorus  

 

 

 

any suggestions on how to speed this up. It seems v bureaucratic. I also read the free install runs out this year  i dont want to get stung with charges because of this consent delay

Read it on Stuff but didnt notice the date was from a couple of years ago. I see the agreement with Crown Fibre has been extended.

I'm pretty sure an aerial tresspass is not permitted with UFB even if the copper it is replacing was running over your property. Somebody else on here may be able to clarify that.

I’ll have to double check on the exact date, but its been extended to sometime around the end of UFB 2. I wouldn’t be surprised if that was kept on even further to promote a majority conversion off the copper and on to Fibre.

 

@mortonman sounds like your property may have been flagged incorrectly as a ROW (Right of way) lease. Yeh it does add a bit of time to the install while our consents team correct the records but should not be more than a week or two.

 

There is however a possibility that, being an underground install, we have to perform work in a shared space. If that is the case then we will have to go through a consents process as required by law. If you want to flick us a DM with your address I would be happy to check and give you a more detailed breakdown. ^Richard

My understanding is if you want aerial trespass on another property then you can get it added as an easement which would mean lawyers and change of title on your neighbours property. But if you get on well with your neighbour or you own the property it is very do-able.

 

Seems like MBIE agrees.

While it may be more difficult especially when involving lawyers to get the title updated to include the easement. But if that is the only option it shouldn't be discounted.
