Subject says it all. Power is underground, fibre and phone is on the poles still.

 

Tree isn't huge, but I'd prefer a good wind storm didn't take the whole street's fibre out, as Chorus has no presence on Waiheke so it can take a while to get someone out to fix it.

 

If it's wasn't in the lines, I'd do it myself, well within my capability....

I understand if it's outside your boundary it's the council, inside your boundary (eg, a tree on your front lawn) is your responsibility.

Sounds like it's me then. Got a friend coming over Waitangi who's a dab hand at tree deconstruction, so we'll see if we can do then then.

Section 128 of the telecommunications act places the responsibility of tree trimming on the landowner or the local council.   

 

If the landowner/council wont trim the tree, they can get an order from the district court to have the tree trimmed and then recover reasonable costs from the landowner/council.    

 

If the tree causes a fault or emergency, they dont need the court order and can go ahead with the trimming then recover costs from the landowner/council.   

 

This applies to overhead lines/branches or underground lines/roots.
