toejam316: You're really thinking about this the wrong way. Something reasonable is any card that's a 970 or greater, or a 1060 or greater, that isn't broken. Also, they do offer advanced RMA, where you essentially buy the replacement card from EVGA and then they refund the cost once they receive your old card.
You're going to be without a gpu for a little bit no matter how you swing it at this point, so I'd either go to the retailer and get a solution though the cga, or use evgas advanced RMA and be happy with what comes back.
You're expecting a lot for nothing, tbh.
I've just been told by an EVGA Representative that the Advanced/Cross Ship RMA isn't available in NZ, where are you getting your info? There's seems to be some confusion as the last representative said Cross Ship was available.

Assuming that the purchase was for personal (not business) use, that's not correct. You have the option of doing everything via the retailer.

I don't think the retailer is doing anything in breach of the CGA. EVGA themselves state that any product purchased from a local reseller should be returned to that reseller for any warranty assistance within the first year of purchase.
I spoken to the retailer again but he doesn't seem to be interested in replacing under that 1 year condition despite it being a marginal 4 months over that period. He's offering to do the RMA for me but says I would be without a card for at least a month.
@Behoder Is this what you mean by having it done all through the retailer? That they organize the RMA for you?

The CGA requires that the product works for a "reasonable" period of time. You have the option of contacting the manufacturer or doing a CGA claim with the retailer.
In this case it's probably going to be easier to work with the manufacturer - note that the CGA does not guarantee continuous possession of an item so it seems that you will be without the card for a period of time while it's being replaced. Can you put up with the onboard graphics in the meantime?

Can I do a CGA claim with the manufacturer? I'm happy to use the onboard graphics but if a Cross Ship is not an option I might leave it until after the holiday period...

cga applies to where you brought it from
I suppose it's probably fair that the retailer won't replace under the 1 year store warranty being 16 months old, I was hoping they might show some leeway. I do wonder though if it's because they don't actually have anything to replace with. There's no graphics cards being advertised on their website.
I've recently learnt that Playtech honors all manufacturers extended warranties which is pretty cool, this may be a recent change in their policy too. It's where I brought the bulk of my PC but not the GPU unfortunately.
I really need to hear back about the cross shipping and take it from their really.
