I have the abovementioned modem that I use for my devices at home. I read on the Battle.net site that to help with lag on Diablo 3 you must make sure that your modems firmware and drivers are up to date.
Seriously I had no idea that the modem needed any update of any kind. I have searched the web and everything I find for Dynalink NZ goes to another site and that site has no info about the RTA1025.

Does the modem actually need to be updated?

Not sure about that particular equipment but you will be looking at a Firmware update rather than software, perhaps google that or maybe on the support page for Dynalink. Best way to know if it's your Modem causing problems is trying with any spare modems you have or maybe ask a friend to lend you one for a couple of hours.

Dynalink sold out to Netcomm years ago, recently Netcomm became Netcomm Wireless. Discontinued models are a bit buried on their new website.

Here's the DSL product page, check the discontinued tab/link
http://www.netcommwireless.com/products/xdsl

I don't see a RTA1025WE listed though, only W or W rev2... maybe WE = W rev2?
http://support.netcommwireless.com/product/xdsl/rta1025w-rev2

Try their live online chat/support maybe during the day, the link is bottom left on the 2nd link
