In theory 'yes', you bought it and as long as you are not sharing it then the 'fair use' terms would cover this as it is the same as making a CD or tape copy for your own use.

In practice: Megaupload.

I sync my music to sugarsync so i can listen to my music on my mobile via 3g or wifi when im not at home. This way every new song that i buy will automatically upload to the cloud and is available to listen to on my phone.

Or to put it another way, the music is on a server you don't have direct control over.

If you have home back-ups no big deal but plenty of people with legit data on Megaupload look like they will loose it.

I'm not worried about losing it as I have a backup copy at home and on an external hard drive, just want to knwo if it's legal to backup music to an online backup service?

I initially only backed up my photos and family videos but recently started to backup my music so i could listen to on on my phone.

In that case yes, it is legit.

Basically when you buy music what you are actually buying is a licence to listen to that music. That licence comes with terms and conditions such as not selling it without permission. But other terms cover fair use and personal copies for format shifting or backing up are considered are fair use under the licence.

I can't quote you the statute or remember the case law but this has been established.

Makes sense.

One of the features of sugarsync is the ability to share files. In this sense, if a user shared a music file, this would be no different to the service that megaupload was offering?

Does this feature make sugarsync just as bad as megaupload?

I have pretty much uploaded my entire CD collection (about 330 albums) to Google Music.

I can access that content from up to 10 devices which include PC's, my Android phones and tablets etc.

While it was a fair bit of work to begin with, I am now re-discovering music I hadn't listened to in years.

And getting back to the OP topic, through Google Music (through processes not dissimilar to purchasing Amazon MP3's) you are able to purchase songs and albums with the added advantage that they are not downloaded but just stored in your online library to be streamed when you want.

No really. When it was out as as beta you could only sign on using a US IP address. They they made it generally available. But for some reason the Android apk is not in the store and you have to side load it.

You can't buy music from the store unless you have an US IP address (an exercise left for the reader) but once you have created an account and found the apk, no much mucking around required to use it.

OP I would like to point out that Megaupload is a cloud based service like your sugarsync if you upload something you have bought and paid for this is not a problem if you choose to share the links or allow others to download it they have not bought the music and or whatever it is making you in breach of NZ copyright infringement law and potentially could be prosecuted.

Whether or not you do share the links and how you feel about that is up to you as a individual.

On your question I have used Digirama several times for purchasing music however they've just merged (or been bought out by or) with Marbecks online.

Digirama was good I found the quality good 256kbps and you could download anything you've previously purchased anytime you like probably the biggest issue I had was that the albums would come in a zipped file format simply called Digirama (if memory serves right) meaning if your downloading it somewhere you've got the other zipped stuff you could potentially overwrite your older stuff (although for most that would not happen). Pricing wise they were good and had regular specials where it would cost you $9.95 for a album. Normal album cost was around $18 (well all I bought were) you could buy individual songs but after a few you may have well just got the album since the songs varied in price.

I have not checked out the Marbecks store and how that works and what their pricing is like although all stuff purchased through Digirama transfers over to the Marbecks side of things once the merger date arrives.

I've got about 20gb of music synced to Google Music, it's a marvelous system. Fire it up in the car and stream away on shuffle. Just got to keep an eye on it as it'll chew through the puny data allocation pretty quickly.
