So in Germany before someone takes a photo of all their mates digging in to a round of pints at the beerfest do they do a round of collecting everyone’s signature that they’ll be ok to take a photo for their Facebook feed?

Formally yes. If I see it and go to him and demand that it be deleted or redacted, he must comply. Especially if it's facebook. I can also demand the same from reporters. But what I don't know ... It becomes dangerous when the recording or photo becomes public. Then nothing helps anymore, because all personal rights have already been violated. You can't simply set up a private surveillance camera that films the public space at random, regardless of whether it is recording or not.

 

So a speed camera would be a hot thing ... because you presume to carry out sovereign tasks of the police. 😁 Even in their evidence photos, the persons must be made unrecognisable. They had to realise this after some people were photographed together with their extramarital girlfriends in their cars and the letter with the ticket and photo evidence was ‘accidentally’ opened by the wife at home. 🤣

 

But I didn't want to hijack the thread, I just wanted to point out that laws are not automatically the same everywhere (for a good reason - see social media abuse) and who knows that i.e. as a tourist?

An individual can take whatever pictures they like in a public place. There is no reasonable expectation of privacy in a public place.

 

 

I don't think so. If you photograph me here against my will as a private person in public or in private, you'll get a lawsuit on your neck that'll be a real pain. The right to my own image lies exclusively with me. It would be different if I were a public figure, e.g. a politician, film star, etc. You are allowed to photograph them in public. You have to ask me BEFOREhand, and even more so if you want to publish the picture. 😊

 

 

The tort of privacy is very clear.

Hopefully with the new Citizen's Arrest laws coming into place, you can rush out and arrest them once captured on camera.
