It was for a VERY well known company too.  But my friend has moved on and loves her new job.

 

 

That's a misuse of it surely? Don't you have to show good faith - i.e. if it's someone you don't want to retain because of poor performance in the first 3 months, you have to show that you've taken steps to improve that issue.  IANAL but sounds like they've opened themselves up to litigation, or at least arbitration.

My advice.

 

Don't use the word dismissed, either in writing or verbal. It really doesn't apply here. Dismissal should be reserved for gross misconduct or serious performance issues. This was 2-3 months into a role and they decided it wasn't working out. More than anything it shows a gap in their recruitment processes in that they hired the wrong person for the role. Probably best for everyone that they recognised that early and used the laws available to them to end the employment contract at that time.

Yep there's definitely a way to spin it that comes out positively for @Op.  I mean if someone I was interviewing said something like "it just wasn't working out for either party so instead of dragging things out we agreed I would look for opportunities elsewhere that were better aligned to where I want to be" then I'd probably put that topic to rest and move on to the next one.

In those circumstances, I wouldn't hold it against you, unless there was serious misconduct involved.  In fact I'd be somewhat sympathetic and more likely to employ you. I'm a sucker for a tale of woe.
