I've been down this road too. Same story, except it was trade me, and I paid $550 for a 2G iphone (this all happened about the end of last year) The line they used was "I am actually selling on behalf of a friend, and they won't give me the phone to send to you"

What I did was: Contacted trade me. The shut down the sellers account, and explained the process I needed to go through to get my money back. Trade Me Sent me a form to the effect of "We will release the sellers details for you to use only for the purposes of court proceedings" So I filled that out (had to be witnessed at the court) and trade me handed out their address.

Then I filled a complaint at the disputes tribunal (cost me $30 I think)
Basically when it came to the tribunal date, the seller realised I wasn't going to let them rip me off, and backed down straight away, and agreed to payback the money. I was payed back within a couple of weeks.

Disputes tribunal is definatly the way to go with this sort of thing. Was a simple as process!

Thats good to know that Trademe are just as on to it as Sella with this sort of thing.


Hopefully, my seller will realise this too when he gets his notice for the tribunal date. I just got mine in the mail today, its set for next month.

Just a heads up prob too late but banks can reverse transactions... even standard account transactions. Hit up the bank and see what they say. A guy from work did this a little while ago.
