Looking at 2degrees plans it will cost 

$39 per month plan -S3 $799 

$799 if you go on a 24 month contract at 39 per month (plan im already on) but I could get one on tradme for the same money so no real benefit there Im guessing and no 24 month contract needed. 

$89 per month plan -S3 Free 

To get it free starts at $89 per month for 24 months. 
So thats spending $2100 over 2 years and getting a $800-$1000 phone free. 

$2100 total spend over 24 months subtract the free phones value at $799 leaves spend of $1301 over 24 month contract which gives $54 per month. 
This doesn't seem too bad, $15 increase p.m over buying outright on trademe or on a $39 p.m plan. 
Good way to get the phone if you dont want to pay up front for it.

Hell no!  From what I have read about the fees, if you down grade from the $89 plan within 6 months you get hit with a special smartphone plan termination fee AND the standard plan change fees (and I think there was another fee also); after the first 6 months you get hit by the plan change fee (and possibly another fee).

Who ever you were talking to Neets was very wrong.

Check out these two documents - they tell you the timeframes and costs.

The early termination fee is $1000
The *special* plan transfer fee is $600 (on top of the standard transfer fees) if in first 6 months
and then there are the standard plan transfer fees also after the first 6 months.
AND... you also loose the Pay Monthly bonuses if you break the 24 month contract...

This was true for the when the original Pay Monthly plans were released, but the terms & conditions changed last year to stop this from happening. And as webup mentioned, when you get a free Galaxy S III there are some additional terms that increase the termination fees to cover the cost of the phone.

When I signed up with them for my free S3 the terms and conditions were given to me as:

"You will also be charged a one-off plan transfer charge of $600 if you change your Plan to another monthly plan within the first 6 months... the one off plan transfer charge will apply in addition to the standard Plan Transfer Charges set out at clause 31 of the Pay Monthly Plan Terms and Conditions."

Clause 31 states that if you're on the $89 plan and you want to transfer down to the $39 plan you will be charged $110.

I was told in the store that no charges would be accrued but this seems to be wrong when looking at the terms and conditions.

The 39 plan lists the purchase price as $799

On Trademe some have been going for 799+
Its not an exact figure just a rough estimate for the sake of the equation and taking account value going forwards.

Seems if you change from the $89 plan even after 6 months you need to pay out the remainder of the 24 month contract up to a maximum of $1000.
So its not worth getting the phone and changing plan as it would be cheaper to buy the phone outright and go on whatever plan you want.

Some people read these threads for a bit of quick info/advice so if you don't know this for sure you should quantify your statement.

The smartphone deal from 2degrees does have special 'smartphone plan' terminations rates on top of any rates you might otherwise incur from changing plans.

This part in the free smartphone terms and conditions

And this section in the pay monthly terms and conditions

(ii) If you terminate this Agreement or end your fixed term Services
(including any fixed term Plan) before the end of the fixed term
you may have to pay early termination charges. Details of early

Care or visiting www.2degreesmobile.co.nz.
(iii) If you transfer to a new Plan before the expiry of any existing
fixed term, you may have to pay Plan transfer charges. Details

Both imply that switching plans without altering the term is not considered termination, and you will only have to pay for plan transfer charges.

Here is what I believe I have done:

I'm already on the $39 / month plan, I have signed to go for the $89 plan for 24 months and got the Galaxy S3 for free plus the following:
1- 1 GB/ month
2- 1 GB / weekend (Touch2Pay offer)
3- The normal $89 plan minutes (460 /month I think) etc
4- Free bus pass for the weekend (Touch2Pay offer)
5- 24 months phone warranty (wohhhhooooo)

So the terms and conditions says clearly that I CAN change back down to my original $39 plan after 6 months. Also to change from $89 to $39 you will pay fees of $110

That makes what I have paid for the phone = ($89 - $39) * 6 months + $110 = $410

I'm paying $410 for the phone, I am also selling my I9000 on trade me and so far it's auction went up to $360 and still running for another week :D so I believe with all the extras I am giving away with the phone I have a chance to sell it for $400 (as I am also offering free signature shipping if you pay $400)

This means I am getting the I9300 for $10 and with that I am getting free bus on the weekends, 24 months warranty and free 1GB for the weekend as well. Not to mention that by the end of the 6 months I will probably end up with thousands of unused monthly minutes HELL YEAH.

Sounds like a sweet deal to me :D

I'm not sure you've read and understood the T's & C's properly... I think it will cost you a lot more than that to get out after only 6 months.
