Hi guys,

This is my first post, but have been a frequent geekzone dweller. 

Just wanting to know some advice/help or even opinion on this.

Last Saturday, i signed onto a $99 shared plan and paid $199 for a iPhone 5s from 2degrees retail store from Sylvia Park. I was planning on switching my number to the new sim card and new phone once my prepaid credit had ran out. So, i hadn't opened the iPhone a week later, when I did open it, I noticed a big black dot on the top right corner of my screen.
So, I took it back it to the store, they were pretty unhelpful and told me they need to send it away to check if there was any liquid or impact damage. Clearly the phone was in perfect condition the protector covers had not even been removed!

Basically, they want to take $46 from me and i will get a refurbished one back?

I think its a little unfair.. and i haven't been able to use my new plan, so I have to pay $99 this month..

What can i do geekzoners?

Go back to the 2degrees store where you purchased the phone from and tell them that under the Consumer Guarantees Act, you will not accept a refurbished phone for an out of box hardware issue that is only a week old. Ask them to swap for a brand new one providing you did not damage the phone.

Bit off topic but when you switch from prepaid to your plan your prepaid credit will go towards paying your first bill. 2 Degrees should have told you that (and completed the sim swap)

Now to the main topic... The phone has a DOA (Dead on arrival) period of usually 30 days, iPhones have a 14 day DOA period from memory.

This means that you can take the whole unit back for a replacement. I would recommend calling apple direct.

Other than the CGA argument would mean that the store would get a reasonable period of time to assess the unit and then the retailer has the right to choose to repair, replace, or refund.

If he contacts apple directly he will get a DOA number and the store will be happy to replace on the spot.

A quick Google indicates that the stores are asked to 'encourage' customers to accept a refurbished item, but bottom line in they have a 14 day DOA policy AFAIK.  The goods were not fit for sale therefore you can ask for a replacement or refund under the CGA.  Don't let them fob you off.






Lazy is such an ugly word, I prefer to call it selective participation

OT: When I've been in to Telecom before to purchase a phone they will unbox it, apply screen protectors etc, which also protects you against this kind of situation.

I disagree.  This page explains why I disagree. Specifically the section titled "The retailer has offered me a refurbished electronic item. Do I have to accept this remedy?"

To be clear, I'm sure contacting Apple directly is also a good option, but the CGA will stand her in good stead if he wants to deal only with the retailer.

Im tempted!! but is it probably too late to refund phone and have the plan cancelled without getting a penalty?


Thanks guys! I will call Apple and see what they can do for me. 

I don't really want to deal with the retailer, the guys were too rude to me, Im just girl :(

Hi, sorry that you've had this issue with your new iPhone 5S.  Please can you PM me your 2degrees number, the IMEI # and an alternative contact number if required so we can get the issue sorted ASAP.

If it is DOA that would be a major fault, the Consumer Guarantee Act provides that in these circumstances the remedy choice rest with the purchaser.

I Have just called them up to have my prepay number with credit transferred to the new sim card on account... and they said it cant be done ... this doesn't get easier at all!

one more thing.. am I supposed to pay $5 for a sim card when i sign onto the plan that cost $99 a month... i remember you used to get the sim for free. i know $5 is nothing to complain about but i just found it weird.
