I've had with the ongoing DNS issues and lucklustre customer service and are going to MyRepublic

So according to Orcon's own website here is the penalty
Fixed Term and early termination charge 9. A minimum term contract of 12 months from the date of installation will apply to the provision by us and acceptance by you of your Orcon UFB Services. Orcon will charge an early termination fee if your Orcon UFB services are cancelled prior to the expiry of the initial 12 or 24 month term.  Early termination fees are set out below: • Fibre 30 = $199
• Fibre 100, Fibre 200, Fibre 1Gbps = $250

However, I just got an email saying I'd up for $900! (I.e. I pay out the 7 months)

I'm a standard home fibre account  100/50...install was standard...what gives?!

Find the clause in said contract that dictates that it overwrites any other agreed terms then refer back to orcon indicating that the contract stats ?? etc should be charged not $900?

As for the pay out clause, This was norm across the first UFB services provided by a number of companies and the reason why I didn't even look at UFB until I found options without it.

Edit:
If you signed up agreeing to the pay out terms, unless you manage to wriggle your way out of it using the info above you will most likely be bound to pay it.

I just like the idea of using a companies own terms and conditions against them.

Yeah, I suspect I was an unlucky early adopter - July last year.  I wouldn't have the foggiest where my "contract" is. As it's probably an online form.  If they make me stay I'm gonna be one hell of a squeaky wheel for 7 months.

Also I'm moving to myrepublic on the same speed connection, doesn't that mean Orcon aren't hit by Chorus' early termination charges?

As you're interested in MyRepublic I guess you noticed they still expect a pay up of remaining months for commercial users, vs a flat $249 for residential.

Give Orcon the option to fix the DNS issue or release you from contact?
Also ask for a copy of your signed contract or voice recorded verbal contract.

True, but the OP does not have/know the terms of service and therefore does not know what his rights are.

On your billing emails there are T&C's about disconnecting early, well at least there is on mine. Unfortunately it's looking very tempting as well.
