This is not on. Second time in a week I receive a SMS with something I am not interested on, and non opt-out information:

 

 

Compare this to another message, from One NZ, received on the same day:

 

 

I guess I will just have to forward the 2degrees message to the DIA.

Wholy crap, Batman!

 

The shortcode used by 2degrees doesn't allow it to be forwarded.

 

So now I am doubly pissed off and will screenshot and send to the DIA.

Unfortunately DIA don't seem to be doing much about this problem. There are so many recent examples of companies blatantly breaching anti-spam laws, yet DIA's web site suggests that they haven't taken any enforcement action since 2023.

Yea my daughter keeps getting these on her phone - yes it supports 4G but only for VoLTE - it's a dumb phone. It can't install apps/visit websites etc.

 

But still they spam her with this.

Won't 2degrees simply say it is a service/contracted message about a service already available as part of their plans (Data Clock), looking specifically at s11(2) of the Act I'm not saying I strictly agree with them using that provision, but I can easily see the DIA/2degrees not doing anything and relying on that provison. May also be why they used the shortcode they use for service related stuff & no-reply.

 

The One NZ text on the other hand feels more clearly marketing so should have the STOP/etc.

One NZ one is certainly marketing...

 

I got one as well mentioning they dropped $1500 in my One Wallet (I did openly sign up to this).

 

However they had some choice words about 2degrees offers only being for new customers...

 

Whilst my mobile is not with 2degrees at all... it's with Contact... a One NZ wholesale MVNO...

The 2degrees one has no useful service or billing information, and is clearly just rubbish spewed out by a corporate marketing department. I can't see how it would be exempted under section 11(2) of the act unless there is something in the 2degrees terms and conditions that states that their marketing department has the right to engage in this harassment. It would be interesting to know if that is the case.

I just had a look at their Pay Monthly Terms & Conditions. Clause 23(2) states:

 

 

As detailed in our Privacy Policy, you agree that we and our Agents may send you marketing messages, electronic or otherwise, about (among other things) our rewards, special offers, competitions and other promotions, and those of our Agents or third parties which we consider may be of interest to you. You may unsubscribe from receiving marketing messages from us and our Agents at any time through Your 2degrees.

 

 

So, it should be possible to unsubscribe via 'Your 2degrees' which I assume is their online customer portal. If this is not possible then they deserve to be sent a breach notice for non compliance with their own T&Cs.

Read again.

 

2degrees does not have the option to stop and the SMS can't be replied to.

 

One NZ is doing it right.

There is no notification or message management option on the 2degrees portal.

I just replied ' Stop ' to the SMS from OneNZ (wallet) and got charged 20 cents

 

Under the legislation I should not be charged for replying ' stop ' to 7414

2Degrees can send you what they want for as long as you're their customer.

 

Complain to them. They should be able to opt you out.

 

If they won't - consider another carrier.  The only way to make any commercial player consider real change is to vote with your $, sadly.

 

Agree this is poor form by 2D.
One thing i've done with OneNZ is configure the contact with silent notifications so at least i'm not interrupted by trivial things. OneNZ def have their share.
