I was just searching the other day and came across a domain name that I think would suit my business rather well. 

It has been registered in the past but it was due to be renewed on the 17th of this month and whoever has owned it hasn't renewed it. 

If I look at the WHOIS information the query status is: 210 PendingRelease

What does this mean? and what is the process a domain goes through after it has failed to be renewed?

From memory there is a stand-down period of 90 days during which the owner can re-register it. After the 90 days it is released and anyone can snap it up.

There are a few services that you can sign up for that will help secure them when they are released, www.expireddomains.co.nz is one that I have used before. Note that if you do use this website you may end up in a bidding war with other people wanting the domain!

I was in a similar situation and I was concerned that if it went past the 90 days I might miss out on it so I contacted the then-current owner to ask if they'd let it go for a reasonable fee. They declined and renewed it.

The same thing happened the next year, but I didn't bother contacting them. Went through the 90 days and I missed out. The new owner wasn't even using it, just holding onto it for an investment.

You can check if they hold IP and if they don't you can register a trademark and take it off them.

Yeah the guy who has it holds it as an investment so don't really want to contact him. Just wasn't sure how long after expiry before others can buy the domain.

I actually managed to manually register a domain that came out of 'pending release' , that had a lot of other people bidding on it in one of these auctions. The thing is that there a quite a few of these types of auction websites, so even if you have the highest bid on one of them, another one that has other bidders on it may also secure it instead. So even being the highest bidder on one won't mean that you will win it. Also the original registrant may renew it.
But I found that I was able to register it before the automated auction system managed to register it. You just have to stay up late at night to catch it in time.
