Received today:

Commerce and Consumer Affairs Minister Jacqui Dean has today released the terms of reference for a review of the Copyright Act 1994.

“Copyright affects how people create, distribute and access information,” Ms Dean says.

“It is important we ensure our copyright regime is fit for purpose in today’s rapidly changing technological environment.

“Launching a review now will also build on the insights of the Government’s Study of the role of copyright and designs in the creative sector, completed last year.

“The Study highlighted a range of opportunities and challenges faced by users, creators and owners of digital content. This review will look into these opportunities and challenges to ensure we have the right settings in New Zealand.”

The terms of reference provide an outline of the objectives, context and process for the review and will be further refined with industry feedback on an issues paper.

“I want stakeholders to get involved in the early stages of the review. In the coming months we will develop the issues paper and will be looking to engage with the wider industry,” Ms Dean says.

Is this in preparation for the failed TPP. I remember that we would have had to change some of our copyright rules and regulations for the original TPP agreement before it got Trumped.

I imagine this could include another look at the 3-strikes laws and other rules around piracy. I image the lobbyists and media companies will be frothing at the mouth.

Lazy is such an ugly word, I prefer to call it selective participation

Could we hope for fair use provisions and legalised ripping of movies similarly to CD mp3?

Any chance that anything relaxes in favour of consumer against business interests/lobby ?

What's the bet this will result in yet another copyright term extension and more powers for copyright holders to attack pirates. Oh, and nothing at all for the average joe.

As I understand it, the US position is basically that the purpose of Copyright is to ensure that Mickey Mouse never, ever goes out of Copyright protection.
So, every decade or so, extend protection for another decade after the author's demise ... rinse and repeat

Hope they do something to let small content creators have some way of dealing with those ripping off their work. Know several people that have had videos ripped off and put into youtube "10 best ....... compliation" and at best all you get is the video taken down. No income at all from the prick who freeloaded its adsense if it was youtube, nothing happens to the person who made it square and put it onto facebook.

You can be sure that the larger copyright holders would get furthur than just some guy who has a youtube channel.

My wishlist:

5-10 year copyright terms
Loss of all rights on authors death
Wide ranging and generous fair use provisions for remixing, mashups, satire, academic, etc usage.
Banning DRM, or at the very least explicitly legalizing the cracking or removal of it
Banning geoblocking
Requiring all content to be available to all distributors under some form of 'FRAND' style licensing (e.g. Sky, TVNZ, Mediaworks, Netflix, Lightbox cannot have exclusives, all get to buy the same video content on the same terms like ISP's with Chorus)
Legislating to prevent regional pricing by declaring content not sold at a reasonable price into our market to be public domain (e.g. If EA release a game for $5 in Russia and $10 in the USA but try and charge us $50, they lose their copyright and anyone in NZ can lawfully copy it)
Lowering/removing criminal penalties for non commercial copyright infringement, e.g. make it a civil only matter, and if you get done for copying a movie, the maximum you pay is 2-3 times the cost of a DVD of said movie.
Increasing penalties for commercial copyright infringement (and no I don't mean torrent site operators, I mean companies that use pirated software, unregistered software, or simply misrepresent numbers for licensing etc (yes we only need 800 MS SA licenses for 3500 desktops.. LULZ)

I called it a wishlist for a reason lol. But unlike the US our politicians aren't totally corrupt yet, so it's possible public interest might still win out over corporate interest in some ways.

I'd rather have it more generic than that. Don't specify "movies", "music", "DVDs", etc in the law; rather just allow making copies of legally-obtained copyrighted works for personal use. This would cover both current and future media and technologies.

I also agree with several of Lias' points; hopefully those points aren't under copyright because I'd like to use some of them when submissions open

The TPPA Amendment Bill was passed into law in Nov 2016. That already extended copyright protection by a further 20 years to 70 years after the author's death.
