Yeah, well judging by this:

patent describes a pen-shaped device with accelerometer-sensed writing, its summary refers to "a portable computer arranged to rest comfortably in the hand".

Either Apple does thinks you can patent an idea or the are totally mad or this is just about trying to block, as opposed to compete with, the competition.

You are completely right to say this shouldn't happen.

I mean Apple is claiming infringement on:

the "unique and refined 'Apple Look'" ... which it claims Samsung snaffled for its Galaxy Tabs.

and

notes the "striking similarity" between Samsung's interface and that of Apple.

So, it's flat and you do stuff by touching the screen? Yeah, that sounds like an idea to me.

Didn't anybody tell you I was a hacker?

Patents were supposed to only be granted after lots of investigatation, ie: not grant things that are obvious and have prior art.

There is no way they could keep up with applications if they did actually did this today, hence the rubber stamping in exchange for monies of all sorts of dumb patents.

Basically the system does not scale to the speed of modern development and innovation, also modern devices are complex and include hundreds if not thousands of patented or patentable inventions. Pretty much everything is built of the back of work done by someone else in the past (on the backs of giants).

Ergo the patent system should be scrapped, let manufacturers compete to produce the best devices.

I believe trademark law is strong enough to protect brands from exact clones and rip offs.

Someone mentioned the car industry not having the same problem earlier, most of the early patents are probably expired by now and the patent office used to be a lot stricter on what they granted.

That HTC stuff is interesting, this could all backfire on Apple. Sure they have deep pockets for lawyers, but once they get a whole bunch of other vendors (HTC, Samsung, LG, Huawei etc) going at them on all sorts of patents they might have ended up biting off more than they could chew.

With all the acquisitions it looks like a lot of the android OEMs are tooling up for a patent 'war' against apple, I wonder how 'organized' this is?

Once they recognise it's mutually assured destruction it will end up with all big players doing cross licensing deals like Intel, AMD/ATI and Nvidia have done for cpu/mobo/video/memory related patents.

However the patent system is still flawed, cosy agreements between big players is anti trust 101 for preventing smaller new entrants in a market.

That's the thing; how can anybody take court case about copying the 'look' or 'feel' of a device seriously?

If I was the judge I would throw it out on the grounds of:

'This is stupid, I and the justice system have better things to do with our time'.

I think the whole thing is ridiculous, Apple wouldn't have even bothered if Samsung weren't a threat to them.

Also, as far as I'm aware, Samsung are only trying to block the iphone in Sth Korea and if they are successful, then they might consider trying in Europe.

As for the copying, anyone who has used either phone (I'm guessing GS1 vs iphone 1-3gs because GSII looks nothing like any of them) will see that the similarities stop at photos taken to make them look identical.

As for the look, well yeah, the GS1 kinda looks iphone 1-3gs looking, but you could say it looks F700ish too.

Anyway, best of luck to either company, I'll buy what I consider best for me at the time, Im not going to limit myself because of a dislike of a company.

I have the GSII and had the GS1 but if LG, HTC, Apple, Sony, whoever, produce a better phone with features I want, I'll buy it!!

I'm not going to be tied to a brand just for the sake of it....unless they pay me $$$$$ and that's not going to happen.

I vote with my money. If I don't agree with the behaviour of some company, I avoid buying their products.

What Apple is doing is blocking its competitors unfairly. If they feel Samsung is copying their design, fine, go after Samsung. But going after HTC, for example, for some silly obvious patents, that's plain abusing the patent system. I understand some people argue if the legal system allows it, it's not their fault. My argument is if they choose to do so even though it's perfectly legal, they have no morality and don't deserve my money.

Same goes for the Microsoft Android and Linux "tax", that's pure mafia behaviour. They charge for something NOT invented by them, totally pisses me off.

That does give many benefits, I agree. Seriously.

One platform with one manufacturer also gives benefits. You get the same one OS but with only one version that is released to all. And integration across a few devices if you have two or some of them, which is cool. Android has the issue that the newer version is manufacturerupgrade dependent. And within that, perhaps model dependent. But in the Apple world you only get one choice of phone type. So, its pluses and minuses. Consumer makes the choice, as always.
