I don't believe it has ever actually been tested in court, and all we are going on so far is some lawyers opinions based on interpretations of various other laws. Laws that were written long before video streaming became a 'thing'.

It's hard to argue it is definitely legal or illegal right now. It seems probably legal, but we can't be sure.

I don't think it needs to be tested in court. There really isn't any argument that it is illegal. Sky are crying 'illegal' but aren't backing that up with any kind of legal opinion as to who - because I don't think there is one.

I love my TiVo, but unfortunately the consortium behind it in NZ couldn't run a p*ssup in a brewery.

Regrettably, because it was/is the best/simplest device bar none, for recording Freeview content. Plus great WAF

I agree with TVNZ, under the principle that they are not required to advertise a competitors product.

and this is no longer a working link as too many viewers "number of allowed playbacks has been exceeded" (wish I could just paste the image!) so Streisand Effect in Full swing :D

Well all this has done for Sky and TVNZ is to give great exposure to Slingshot and its Global Mode service, and to show the population of NZ that there are way better options out there.

With an election a few weeks away, I can see a politician picking up this ball and running with it.
It won't be one of the major party pollies, but one of the smaller party ones.

Unfortunately, the only thing I see happening is Netflix blocking NZ users. Slingshot better hope that doesn't happen, as all the goodwill and sentiment with evaporate pretty damn quick then. I for one will be mighty annoyed if Netflix stops NZ users from accessing it's content because of a little hullaballoo in the South Pacific (and it will be back to other methods of getting content I suppose).

In an ideal world, the studios would do away with reginalising their content, and license it to whoever wants to pay their prices. Everyone (except maybe Sky, but they can adapt??) wins then.

By getting more creative with their current blocking tactics. And there are some simple steps they can take to do this. FI, I was able to successfully sign up using my NZ credit card. Removing that ability would make it far less convenient for NZ users to use it. In our case we could get around it with our another card probably, but there would be many who don't have that luxury.

lots of ways.
Most will have workarounds, but the harder the workaround, the less bothered people will be to do it.

examples:

requiring US credit card
requiring address verification in the US (like Trademe does if you want to be 'address verified')
requiring valid social security number to match the name
requiring US based ISP account verification (a little like HBO Go requires you to verify it by checking against your cable TV subscription)
requiring US mobile number, verified with SMS

Even just requiring a US credit card would wipe out most people's subscriptions. Most people in NZ don't have a 'one smart' and even if they do, loading it with USD all the time is a PITA.

No. Because:

a) It is not within ASA's jurisdiction
b) Broadcasters aren't obligated to provide their air time to anybody who wants to purchase it.

Since DNS unblock services still give you a direct connection to the video files, what is stopping them from blocking all NZ IP ranges?
Only way to use it then would be via a VPN

I'm glad TVNZ was honest about why it isn't playing the commercials, whereas Sky is being a bit intellectually dishonest.

However, Slingshot is also being intellectually dishonest when they say that refusing to play the commercial are "anti-competitive" and that it is "undue censorship". Get a grip. Saying that it is censorship is like people who get banned from a discussion board and then email the moderator screaming that they are being censored. Utter nonsense.

of course you could.
But (see my bolded part above) the point is, most people won't. The studios don't really care about making it impossible. They accept there will always be people who get around it. Their goal is to make it too hard for most people to bother.

Ah, but we were talking NZ, not everyone in the whole world. (At least how I understood it).

These measures would make it harder for anyone outside of the US to sign up for the service, not just Kiwis.

That said, even with those kind of measures there would be work arounds to get access, and I could even see a possible market for selling accounts to people outside of the US if this happened (in much the same way the GEO-blocking has created a market for unblockers).
