TIVO is not freeview. There is no obligation for TIVO to do anything really as things change as they're not formally in NZ anymore. We're just lucky some company is still providing some level of support to include this new channel and are still bothering to supply the EPG data etc.

I think there is a obligation, rather than luck, otherwise everyone will be returning their tivo to their retailer for a refund, which they wouldn't want. You make the CGA sound like it is difficult to get a retailer to honour, but it is not difficult at all if you get your facts right. I have never had a problem. I would expect a PVR to last at least 5 years, not too sure how long consumer says a PVR should last.
But a PVR without an EPG, would make it not fit for purpose, nor have the features that it was advertised with. It is just a pity that the EPG isn't OTA, like on other devices, then it wouldn't matter if the company disappeared. That is why I am wary of any hardware or software that you buy outright, that needs to regularly phone home in order for it to continue to function normally. I had this problem with a top brand scanner, where the company that made the scanners OCR software stopped trading, and the software ceased working, and the retailer had to refund me, as the scanner was unusable for me.

I agree, they possibly only an obligation for the EPG of the channels that are advertised on the tivo box at the time of purchase. Prime and maori tv weren't on the EPG for a long time.
But it would be reasonable to expect the EPG of channels to be available, if it is available on other freeview type platforms, as channels get added and removed over time.
johcar: On both my TiVo devices I am receiving Sommet Sports on Channel 364 here in Auckland.
One TiVo is an original beta test device (160GB HDD - model TCD663160) running software version 11.3b5-01-2-663
The other is a post-launch device (320GB HDD - model TCD663320) running software version 11.3b5-01-2-663
It would be interesting to see if there is a variation in the software version for those not seeming to be able to receive Sommet...

foamfollower: As of mid-day Sommet went live and unhidden - and it is on my Tivo after a channel scan. On Facebook Sommet said it would appear on Tivos "initially". Wonder what that means?
