Thats a peony.
The whole plant will die down, so wait until the whole thing goes brown before trimming the unsightly leaves etc.
It will come to life in spring. Give it a bit of blood and bone during spring.
As for the poisoning you may have missed the opportunity to hose down the plant with plenty of water.
Weedkillers target most weeds and you might be lucky and the plant may survive.

Buy it from a garden centre or the Warehouse. Or use slow release gplant fertiliser.

Bung: Do you know they got sprayed with weedkiller or were you assuming from the look of the leaves?
I have evidence some weedkiller bottle in the shed, undone job randomly spraying everywhere in the garden(another rose plants same still suffer from poisoning) and the look of the leaves(from my gardening experience before I came to NZ)
