Jase2985: the first picture makes it look like your going into the bus lane, many many people swing out wide and over the lane markings only to end up in the left hand lane. from that picture its does not look at all like you intended to go into the right hand non bus lane

looks like you are in the unfortuneate position of the evidence points to you doing the crime when you actually didnt

Based on the idea that it's innocent until proven guilty; is it not evident that the fact that my drivers wheel is on/over the white lane after leaving the intersection, that it's completely reasonable to believe I used/had the intention of using the correct lane?

It looks like they are concluding from that 2nd photo that you travelled the entire length of that piece of road in the bus lane. That's a bit of stretch. You should ask them what their exact and specific allegation is, from where to where.

Aaroona: I will post the actual photos tomorrow. I have to plug in the scanner to scan them in.

Gmaps was just easier cause it's there.

Scanner??? I have thought everybody on geekzone to have a smartphone or a digital camera...

I ended up using my camera to take a picture of the pictures lol. Scanner failed.

yes it should be innocent until proven guilty but the evidence seems to point to you being guilty. yes you may not be guilty, but AT seem to think you are and they have no other proof of you committing the alleged offense. they are going off whats in-front of them and it looks like you are guilty. they are just missing a photo of your car half way down the bus lane to confirm that.

no its not, i sit at many an intersection and watch people taking left turns, and about 1/5 at a stretch execute them correctly when more than one lane is involved. some will go strait into the RH lane, others will cross the line and end up back in the LH lane. The photo makes it look like you are going into the LH (bus) lane, but you have gone a little wider during the turn.

thats how i see it. you are innocent, but try and prove that if you were to go to court as the evidence seems to suggest otherwise

Innocent until proven guilty applies in criminal cases only. In civil cases such as this, it's "balance of probabilities". I.e. if there's a 51% chance that you were in the wrong, they win.

Bus lanes are a pain in the a** and should be removed form all cites. The amount of businesses affected by loss of sales due to not being able to park outside them during peak traffic times is insane. How many people used to park outside of a coffee shop in the morning or pickup bread and milk from a dairy on the way home. Because of bus lanes you can't unless they have off street parking and even then most people don't bother.

Not to mention people who can no longer park their cars outside their house. Bus lanes simply inconvenience businesses and property owners for the sake of a few people on a bus.

Regarding OP I am siding with you that you did nothing wrong.

The whole idea about how we transport humans is flawed. There needs to be a new way.
AT is just a bunch of clowns to start with., You try all these disputes so fourth and 90% just get crapped on.

* That goes for clear ways too. The amount of business lost for those people on Halsey street next to the bakers and stuff.

Great question, I don't know.

This is some of the wording I Received from them regarding this:

"... In Auckland city, enforcement zones are set up and measured at pre-determined sites and all exceed 50 metres in length. Motorists who travel in the special vehicle lane and exceed the length of the enforcement zone may incur an infringement notice."

This makes sense why they think I may have used the lane incorrectly; i.e. start taking pictures at 100m then again when close to the camera.

Whether it is video or pictures only though, was not specified.

If they just have someone stuck behind a pole the easiest way would be to video everything and just note the times to extract start and end points for offenders.

I have seen them videoing in the Onewa Road transit lane. I'd assume they videod and then just take out the still to send to you.

Okay I will go by photos and possible council or AT whatever side. NOTE. This does not mean I believe you are guilty as I wasnt there. Just another view that can be taken purely on photos.

First photo shows you on side road wanting to come out onto this road. Shows what we will refer as bus.
Second photo shows you pulling out behind bus and conclude by angle of front wheels you are going into the bus lane.
Third photo shows said bus behind you in other lane and you driving over bus stop. Assumption will be drawn you have driven entire way in bus lane.

Now I am not say you are innocent or guilty, just going by the photos you have shown. I wasnt there and I dont know the area. Just pointing out that by the photos you will need to explain to AT etc what happened as they will use those photos to come to the conclusion you drove all the way, even you you didnt. You need to have a defence for that scenario.
