It will be a very interesting case to see go to court ( I suspect Wilson will settle before trial, as an open court will open up their business operations to scrutiny they will want to avoid)

 

But if it did go to court I think Wilson would win based on the law cited, as at the time of the acquisition there was considerable competition for them (James smith- 850 places (400 meters away) , and Readings -900 places - 700 metres away)

 

HOWEVER, 6 month after the acquisition this competition was eliminated by the Kaikoura Earthquake.....

 

IMHO ( and IANAL) The Commerce commission  really be arguing Section 36 , taking advantage of Market power....

There was an item on the news last night about Brisbane having the most expensive parking in all of Australia. Lack of competition (Wilson's again) seems to be a major factor in this.

No. Wilson is the weaker competitor, with the majority of the gouging resulting from Secure Parking's immense market presence. At $55 AUD per day we're still beaten out by one or two places in Melbourne charging $72 AUD per day, and it doesn't help that Brisbane City Council itself joins in and charges the same monopoly prices ($500 for monthly parking? Get out, even Secure doesn't dare charge like that!)

 

Brisbane does also supposedly have the cheapest hourly parking of the three major capitals (apparently $12 is cheap). Least that's what I saw of the article, and I'm not paying money to read the Courier Mail.

Wilson Parking has been forced by the commerce commission to give up the lease on three Wellington parking buildings as it has materially reduced competition. They also had to pay $500K to the commerce commission for legal costs.

 

It's a good start, I guess.
