Hi,

I drive a company car which has an expired registration (expired end Feb 15).

I have reminded my boss several times of this, but he doesn't seem too fussed. My question is who would be fined if this is spotted on the road in its unlicensed state? Me personally or the registered owner, my boss?

you are if you're driving the Vehicle it is your responsibility to make sure the vehicle is legally allowed on the road

i think similar to how a truck driver is responsible for their load (even if someone else loaded the truck) as the driver of the company car it's your responsibility to check its regoed and warranted. Even though this isn't your financial responsibility.

In theory I don't think your employer should be knowingly allowing this to occur

Just My opinion tho

You would be. The driver is responsible for the legal and safety status of the vehicle.

Your only option would be to refuse to drive until it is rectified.

If you look through your contract you will probably find that it states this.

Did you remind him via email, so you have a "recorded" trail ?

Whilst you could refuse to drive, I guess the car is needed for visiting customers, and you'd not be able to perform your primary job function without the car.

Bit of a catch-22 :-)

Maybe he is waiting until July 1st (when relicensing costs go down).

He will be disappointed if he is, because I'm pretty certain Car Licensing is backdated.

Are you joking? The deadline was back in February. He doesn't have a choice and either do you. The car is not licensed for use on New Zealand roads. You cannot drive it until it is relicensed. End of story.

No catch 22 at all, your employer cannot require you to break the law.

I would be finding myself a new employer, personally. Or at least refuse to use the vehicle until it is road legal. You will be liable for any infringement while you're driving an unlicensed vehicle, and if your boss doesn't care to renew it, I doubt he'll care to pay your fines for you.

correct, its called continuous vehicle licensing and will be back dated.

Thanks - I've sent him another email and this time I think he has taken the hint and gone off to the Post Shop. Thing is it's not just my car, it's also a colleagues and (get this) his own car!
