quickymart:

How ridiculous. Did Hillary "challenge" Trump to prove he won the election in 2016? I don't remember anything like that happening.

I do remember her conceding (reasonably) gracefully, however.

Trump said Biden had to prove he won. Actually whoever brings a claim needs to prove it, so Trump is obviously being a douche.

quickymart:

So - dumb question - but what if somehow the Electoral College votes for Trump on December 14? He stays in office, despite losing the election? Someone please help me out here.

It is a possibility since some states allow Faithless Electors - but not all of them.

More legal Whac-A-Mole ...

The Washington Post - Pennsylvania Supreme Court dismisses lawsuit against mail ballots with prejudice in another defeat for Trump

today

The Pennsylvania Supreme Court dismissed with prejudice * a Republican lawsuit seeking to invalidate more than 2.5 million votes cast by mail in the general election, the latest in a string of legal defeats for the GOP as President Trump fails to undo his losses in key battleground states.

Justices on the state high court ruled unanimously late Saturday that Republican petitioners waited too long to file their suit challenging Act 77, the 2019 law that established universal mail voting in Pennsylvania.

Trump allies had asked the court to invalidate all votes cast by mail in the most recent election or direct the majority-Republican legislature to choose a slate of presidential electors.

The court’s written order called the latter option “extraordinary,” noting that it would disenfranchise 6.9 million voters. ...

Concurring, Justice David N. Wecht noted that the GOP petitioners “failed to allege that even a single mail-in ballot was fraudulently cast or counted.” ...

*  A case dismissed with prejudice is over and done with, once and for all, and can't be brought back to court.

Isn't there some kind of sanction for frivolous lawsuits? Trump (or at least Giuliani) surely qualifies by now.

You can be charged with barratry, but it's very rarely done. In particular it'd be dangerous in the US because the right would see it as an attempt by the judiciary to disenfranchise them. Better to let the suits get thrown out one after the other with a definitive ruling on each one.

Barratry is very rare, tends to be given to lawyers, and the poor who represent themselves.

Here's a good paper called "Subsidising Litigation" by the New Zealand Law Commission, which compares the US to New Zealand, and others.

The rich and powerful can usually file as many cases as they like, knowing they'll almost never directly wear the consequences, beyond "bad optics" and countersuits.

So Trump is in the clear, because suckers will fund any countersuits, and he's definitely not worried about "bad optics"

Rudy Giuliani and fellow lawyers could be disbarred.

The New York Times - Splitting 5 to 4, Supreme Court Backs Religious Challenge to Cuomo’s Virus Shutdown Order

26 Nov 2020

WASHINGTON - The Supreme Court late Wednesday night barred restrictions on religious services in New York that Gov. Andrew M. Cuomo had imposed to combat the coronavirus.

The vote was 5 to 4, with Chief Justice John G. Roberts Jr. and the court’s three liberal members in dissent.

The order was the first in which the court’s newest member, Justice Amy Coney Barrett, played a decisive role. ...

Another small move toward the US becoming what the US used to despise.

A council of unelected, appointed for life grand-wizards, interpreting an ancient text to overturn policies enacted by democratically elected representatives of the people, and done to appease a "higher authority" - the invisible man in the sky.

From here:

A Newsmax/McLaughlin poll of Republicans and independents who vote in Republican primaries found that a whopping 68 percent would pick Trump in the 2024 primary out of a field of 13 other candidates including Pence and Sen. Ted Cruz (R-Texas). Among Republican voters alone, 53 percent told pollsters they’d pick Trump in the primary, with Pence trailing at just 9 percent. And if Trump doesn’t run, Pence may be duking it out with Trump’s oldest son, Don Jr., who tied with Pence for the lead at 20 percent. “In a crowded field of 14 possible candidates for the 2024 Republican primary, no one comes close to President Trump,” pollster John McLaughlin told Newsmax.

Republicans completely lost the plot. They are evil.

IIRC the % of Republican voters who register for voting in primaries is much lower than the % of Democrat voters who register for voting in primaries.  This also biased because of state requirements for registering for primaries varies from state to state - more pre-register in blue states. So the 68% figure of Republicans who'd vote in primaries supporting Trump probably doesn't accurately represent the overall % of Republicans who'd support Trump.  Sorry that seems to go around in a circle because if he's selected, then Republicans will vote for him anyway, because they'd vote for any Republican candidate, because Democrats are evil communist paedophiles who'll take your guns, your money, organise death squads to ration healthcare, and all the other CT that Trump voters believe.

The Washington Post - Wisconsin recount confirms Biden’s win over Trump ...

today

The recount of presidential ballots in Wisconsin’s two largest counties finished Sunday, reconfirming that President-elect Joe Biden defeated President Trump in the key swing state by more than 20,000 votes. ...

As a result of the recount, Biden’s lead over Trump in Wisconsin grew by 87 votes.

Under Wisconsin law, Trump was required to foot the bill for the partial recount - meaning his campaign paid $3 million only to see Biden’s lead expand. ...

That works out at ~ US $35,000 per lost vote.

It's schadenfreude time!   😐
