Fortune: Investigators already have Trump’s tax records, as outgoing president faces losing legal protections

Investigators probing President Donald Trump’s finances have gotten hold of some of his tax records, allowing them to move ahead even without a Supreme Court order that would give them eight years of his returns.

Manhattan District Attorney Cyrus Vance Jr., who subpoenaed Trump’s accounting firm Mazars USA in 2019, is leading one of the most closely watched cases that could result in criminal charges. While Vance agreed to await a high-court decision on forcing the handover of tax records from 2011 to 2018, his office now has some of the information from other sources, according to people familiar with the matter.

That information could help Vance support allegations that Trump’s company used accounting gimmicks to overstate the value of its assets when applying for loans and underplay it to reduce its tax bills, according to the people, who asked not to be named because the matter is private.

Charges aren’t imminent as Trump departs Washington. But losing the election in November meant Trump also will lose what presidential protections he had when he’s replaced by Joe Biden at noon. Among those he claimed: that a sitting president cannot be charged with a crime.

No Sweeping Immunity

Trump invoked that longstanding Justice Department policy to fight Vance’s request for the tax records. In July, the Supreme Court rejected the president’s bid for sweeping immunity but left open the possibility that he could make more specific objections. Lower courts have since rejected Trump’s arguments that the subpoena is overly broad and was issued in bad faith, and the matter is once again before the Supreme Court.

Vance’s decision to hire financial consulting firm FTI Consulting, which was reported by the Washington Post last month, suggests that the prosecutor has already identified examples of potential wrongdoing at the Trump Organization, according to the people.

I know, the Mirror is sensationalist tabloid . . but they are not wrong in this article.

Mirror: Donald Trump's legal worries as court cases build up when he leaves office

...there is an ever-lengthening string of potential charges mounting up against him.

Allegations range from sexual misconduct, using his office for profit, falsifying business records, pressurising officials to "find" more votes, and obstruction of justice.

The Justice Department has long has a policy of not prosecuting sitting Presidents, but from midday today, Trump no longer has that protection.

It is unlikely - but not impossible - that Trump could face federal charges, but to do so would be a dangerous call politically.

...It's a different story with state charges - and Trump could face plenty of those.

He is being investigated by the State of New York over possible bank, tax and insurance fraud.

...On top of that, investigators are also looking at claims he falsified business records to hide payments to adult entertainer Stormy Daniels, who claims she was paid off after having an affair.

Again, it remains to be seen whether the Democratic state decides to take action, and whether Biden would intervene.

Civil action could come from several angles.

Agony aunt E Jean Carroll alleged in a 2019 book that he raped her over 20 years ago.

He denied it, as he does all the claims, saying she was not his type. She sued him, but the US Justice Department moved the case from state to federal court.

Now as a private citizen and a defendant in a civil suit, Trump may be compelled to provide evidence.

Similarly he is being sued by former Apprentice contestant Summer Zervos for defamation after he accused her of lying after she said she was sexually assaulted by him.

Also in the civil courts, New York Attorney General Letitia James is investigating whether the Trump family’s real-estate firm falsely filed property values to secure loans or tax benefits.

Trump and his three eldest children were sued for fraud in 2018 over their endorsement on Celebrity Apprentice of ACN Opportunity LLC.

He could now be compelled to appear before the courts.

To make matters worse, his niece Mary Trump has also sued him, alleging he conspired with his brother and sister to defraud her of millions of dollars from her grandfather’s estate.
