The Washington Post - The criminal indictments against the Trump Organization and Weisselberg

What Trump’s company was charged with: 

 

Trump’s business, including the Trump Organization and the Trump Payroll Corp., was charged with 11 crimes, including a scheme to defraud, conspiracy, grand larceny, three counts of criminal tax fraud in the first degree and one count of criminal tax fraud in the fourth degree, and four counts of falsifying business records.

 

What Trump’s chief financial officer was charged with:

 

Weisselberg was charged in all 11 counts that applied to the Trump Organization, plus four additional counts of offering a false instrument for filing, which essentially means prosecutors say he lied on his taxes. They say Weisselberg avoided paying more than $130,000 in taxes he should have paid.

 

 

 

 

Note that, if convicted, Weisselberg (aged 73) could face a 15-year prison sentence.

Here is a serious call to place a gag order on Trump. What a relief that would be, not to mention an essential step in the prosecution against his organisation.

neb: I doubt they'll ever get through to the Teflon Don, he'll sacrifice his underlings as usual and escape any consequences himself. What it will do though is distract him from causing more mischief. The downside is that it plays right into his fans' persecution complex.


I wouldn't be so sure Trump will get off unscathed.

White collar criminals are terrified of jail / bankruptcy through fines.

I'm sure many will instruct their lawyers: "I don't care how we do it, I'm not going to jail. I recorded all my meetings, including ones with Trump. Maybe I could turn state witness against Trump, and get immunity?"

It's what prosecutors do with drug dealers: climb the ladder. Get the small ones to give evidence against big ones.

Another reason why he might be inclined to "flip" is that being caught lying in criminal court could add to the sentence, but not lying consistently enough - in the way Trump may expect will absolve him - is going to bring down Trump's full wrath (with the entire GOP backing him) - which is what Trump has done consistently to anybody who dared.  There's a long list of lieutenants in the crime syndicate who Trump's thrown to the wolves. 

 

His options are binary - "hero or zero". The charges are for a paltry sum in the grand scale of things, just a few millions.  He'll know that's the tip of an iceberg.  He's going to have to choose sides - then be all in.

WP: 'Prosecutors charged former president Donald Trump's business with a 15-year "scheme to defraud" the government and charged its chief financial officer with grand larceny and tax fraud in a Manhattan courtroom Thursday, describing what they said was a wide-ranging effort to hide income from tax authorities.'

 

Trump org is accused of double bookkeeping, pretty much what Cohen said. This really looks like a major effort to squeeze Weisselberg until he turns. Otherwise it seems pretty anemic.

Despite being impeached twice, former president Donald Trump is not the worst president in U.S. history *, according to 142 presidential historians surveyed by C-SPAN ...

 

The historians do not rank the presidents themselves. 

 

Instead they are asked to rate each president on 10 leadership categories; the averages of all of the ratings are then ranked. 

 

The 10 categories are public persuasion, crisis leadership, economic management, moral authority, international relations, administrative skills, relations with Congress, vision/setting an agenda, pursuit of equal justice for all and performance within the context of the times.

 

  • Trump got his best average rating on public persuasion, in which he came in 32nd. 

  • On moral authority and administrative skills, however, he came in dead last. ...

 

 

 

* The historians deemed him the fourth worst of the 44 former presidents.

I have nothing but contempt for Trump.

 

That said, I feel similarly about the liberal NY prosecutors. They going after Trump Org purely for political revenge. The amount of resources and emphasis they are throwing at the case are totally disproportionate to the current charges before court.

 

Witch hunt, pure and simple. It will only bolster his supporters.

The "liberal NY prosecutors" are attacking Trump the only way that they can - starting at the bottom of the Trump pyramid, and working upwards.

 

Unfortunately, this will inevitably be perceived as a "witch hunt" by Trump supporters.

 

The alternative is to do nothing, and let the Orange Fart win by default.   🙄

I agree the optics aren't great, but I think it goes beyond simple revenge. I believe Trump is a criminal and has created a criminal organisation. He has been compared to a mafia boss. He has layers of protection that make it difficult to legally pin anything on him. I think the prosecutors are using anything they can, just as tax evasion was used against Al Capone because he kept murdering witnesses to his other crimes. They are working their way up to Trump and I hope they succeed in nailing him in the end. They are at a disadvantage because they have to play by the rules and Trump doesn't given a diddly damn about the rules.

I’d love to see just one other example where charges as trivial of not declaring school fees or use of cars in an employee’s tax return has commanded the full force of the NY judiciary.

 

Normally, investigations follow an alleged crime. On this occasion, the investigations are in search of an alleged crime.

I think Cohen pointed to several alleged crimes. So may have the ex of Weisselberg's son. As always, the devil lies in the difficulty of establishing a legal case that will meet the threshold of proof demanded by courts. I don't doubt the prosecutors have uncovered plenty of wrongdoing, but proving it is another matter. I think they are focussing on what they believe the have a chance of winning. That is the crack that will open the wall.
