The NY Times - Judge Grants Trump’s Request for Special Master to Review Mar-a-Lago Documents

A federal judge intervened on Monday in the investigation of former President Donald J. Trump’s handling of sensitive government records, ordering the appointment of an independent arbiter to review a trove of materials seized last month from Mr. Trump’s private club and residence in Florida.

 

The judge, Aileen M. Cannon of the Federal District Court for the Southern District of Florida*, also temporarily barred the Justice Department from using the seized materials for any “investigative purpose” connected to its inquiry of Mr. Trump until the work of the arbiter, known as a special master, was completed.

 

The order would prevent, at least for now, federal prosecutors from using key pieces of evidence as they continue to investigate whether the former president illegally retained national defense documents at his estate, Mar-a-Lago, or obstructed the government’s efforts to get them back. 

 

It also appeared to grant Mr. Trump special deference as a former president, rejecting the Justice Department’s repeated assertions that it would pursue investigations of Mr. Trump just as it would those of any other person.

With this much publicity, the case is not going to go away.

Even at a snail's pace, I'd expect the "special master" to take a year.

This means it puts it closer to the 2024 election cycle.

The FBI already know the contents of every top-secret document; so not allowing the Justice Department use the materials is pointless; it's equivalent to saying "Someone printed a Word document from an archive, and I shredded it in the bathroom and threw it in the toilet to delete it."

The Justice Department just have more time and be better organized at the end of this pause.

In the meantime, to anyone who has half a brain, it'll be a transparent attempt by Trump to avoid justice.

I'm sure Trump will be pleading the Fifth amendment, against self-incrimination, when the case comes to trail, which will further erode his credibility.

An offshoot is I'd expect a MAGA terrorists or two to be embolden to attack law enforcement. Again not good for mainstream Republicans.

Interesting comment from the always-insightful Perun (who I reckon is a front for a think tank at the ADFA because no one person can produce that level of analysis by themselves :-) that if you poll people in the US and ask whether they support the US response to the Ukraine issue you get a completely different answer to when you ask whether they support Biden's response to the Ukraine issue, even though it's the same thing.

 

 

Which goes to show how brokenly polarised the US.

I found this old article from 2016, pre-Trump presidency, based on a 2012 book The Wisdom of Psychopaths

It says more about voters than politicians.

Some seized documents were so closely held, only the president, a Cabinet-level or near-Cabinet level official could authorize others to know.

 

A document describing a foreign government’s military defenses, including its nuclear capabilities, was found by FBI agents who searched former president Donald Trump’s Mar-a-Lago residence and private club last month, underscoring concerns among U.S. intelligence officials about classified material stashed in the Florida property.

 

Some of the seized documents detail top-secret U.S. operations so closely guarded that many senior national security officials are kept in the dark about them. ...

 

Records that deal with such programs are kept under lock and key, almost always in a secure compartmented information facility, with a designated control officer to keep careful tabs on their location.

 

But such documents were stored at Mar-a-Lago, with uncertain security, more than 18 months after Trump left the White House.
