The New York Times - Jan. 6 Committee Refers  Former President Trump for Criminal Prosecution

WASHINGTON - The House committee investigating the Jan. 6, 2021, attack on the Capitol accused former President Donald J. Trump on Monday of inciting insurrection, conspiracy to defraud the United States, obstruction of an act of Congress and one more federal crime as it referred him to the Justice Department for potential prosecution.

 

The action, the first time in American history that Congress has referred a former president for criminal prosecution, is the coda to the committee’s intense 18-month investigation into Mr. Trump’s effort to overturn the 2020 election that culminated in a violent mob of the former president’s supporters laying siege to the Capitol.

 

The criminal referrals were a major escalation for a congressional investigation that is the most significant in a generation. 

 

The panel referred five other Trump allies - Mark Meadows, his final chief of staff, and the lawyers Rudolph W. Giuliani, John Eastman, Jeffrey Clark and Kenneth Chesebro - for potential prosecution for actions the committee said warranted Justice Department investigation. 

 

The charges would carry lengthy prison sentences if federal prosecutors chose to pursue them.

A gesture, not an indictment

 

If Mr Trump were convicted of the crimes the committee has accused him of committing, he could face hundreds of thousands of dollars in fines, up to 20 years in prison and be prohibited from running for future political office.

 

The committee's vote, however, is largely symbolic.

 

Congress does not have the ability to charge Mr Trump with any of the listed federal crimes. That power lies solely in the hands of the US Justice Department, which is part of President Joe Biden's administration.

 

With its vote, the congressional committee members have, in effect, recommended the Justice Department act. They have laid out the case - the means, the motive and the opportunity - as they see it. 

 

And, perhaps most importantly, they have provided a trove of the supporting evidence gathered over nearly two years of interviews, subpoenas, document reviews and legal battles.

 

What the Justice Department does with all this, however, is entirely out of the committee's control.

Thanks, Sideface. The "Introductory Material to the Final Report of the Select Committee" is well worth downloading and reading. Sure, it's 103 pages but the last 50 are just document references. Note that although this pdf is only 'introductory material', it offers an excellent precis of the total information upon which the Justice Department will base its actions. No. 45 is going down, down, down :-)
