...so often when somebody commits a crime it can violate both state law and federal law.

I'm pleased to report Donald Trump has done precisely that with that corrupt ask:, "just find me 11,780 votes and corruptly declare me the winner", he not only violated Georgia state law for soliciting election fraud but he also violated it violated any number of federal laws.

...So for anybody scoring at home it's title 52 of the United States code section. In summary:

"a person who in any election for federal office knowingly and willfully deprives the frauds or attempts to deprive or defraud the residents of a state of a fair and impartially conducted election process by false fictitious or fraudulent tabulation of ballots commits a five-year federal felony "

that is precisely what Donald Trump did on that corrupt phone call.

He could easily be charged with a Criminal violation of that statute and frankly plenty of others

Because I think the big ticket crime that we're going to see indicted against Donald Trump and others for this whole scheme to try to corruptly overturn the 2020 presidential election results is going to be a conspiracy to commit crimes against or defraud the United States

I predict that's going to be the umbrella charge and then a whole lot of more specific Federal statutes will be indicted because he violated any number of federal election laws

I think what's so telling here is that everybody kind of assumes that the Fulton County case is such a home run because we have that audio recording of him pressuring Brad raffensberger to find those votes

but it is just as much of a home run in the January 6th case in the federal case that Jack Smith is going to bring forward so I think that that bodes well for both of those cases

My Theory:- A good part of America's current problems is that most everyone is labelled either a Democrat or Republican. Fancy living in a country where many officials are swapped out after elections. Fancy having Republican or Democrat high court judges installed for life. Or having the sherrif voted in by party. Etc, etc,etc.

 

The mind boggles.

Agree. In large part that is a result of the USA state political system. In many states if you want to participate in a presidential primary aka 'caucusing' then you must first register as a member of the party you want to 'caucus' for

The primary system and regulation in various states to a greater or lesser extent does tend to encourage identification with a particular party and then a candidate. It's common to hear people say "I registered as a Republican this year because xyz".

 

In the actual presidential general election anyone can vote.

and the thousands of party driven appointments under those being a potential pork barrel affecting which company the government funded office buys paperclips from right up to the president with the biggest barrel of all.

The structures set up by the Founding Fathers, along with the Constitution, haven't been fit for purpose for a long time.

 

Unfortunately solving these problems would only benefit the greater population and not the political and business classes so there is absolutely no prospect of fundamental change. The USA will continue its death spiral until it reaches that condition they so despise - a failed state.

The Washington Post - Trump seeks trial delay, citing legal and political factors

Former president Donald Trump’s lawyers argued in new court papers that for a host of legal and political reasons, the trial should be pushed beyond the December timeframe proposed by the Justice Department, and possibly after the November 2024 election.

 

In a 12-page filing late Monday night, Trump’s lawyers claimed that putting the former president on trial later this year for alleged mishandling of classified papers and obstruction "would result in a miscarriage of justice.” ...

 

Trump and [his co-defendant] Nauta, the new filing argues, are going to be too busy with a presidential campaign to properly prepare for a criminal trial at the end of this year.

 

 

Poor Donald - a victim of the deep state - again.  🙄

He won't get anywhere with that - the proposition is ridiculous. Basically it's saying that anyone could easily stave off pending criminal proceedings by declaring their candidacy for a high office.

Maybe there is hope, after all:

 

The problem with suggesting a specific date soon after the election, from his team’s point of view, is the possibility that the judge might “split the baby” and choose a date midway between the two sides’ proposals. That could mean a late spring trial that finishes well before the election. A Politico/Ipsos poll last week says that a conviction could cost Trump more than a quarter of Republican votes.

 

So at this stage, Trump would rather go for broke and hope Judge Cannon buys his argument.

 

25% of votes is quite a lot to lose.

Trump actually has a lot of trials coming up

 

October 2023: Trump, his children and the Trump Organization will go on trial in New York City on whether they committed tax and business fraud by changing the value of their properties to dodge taxes or trick investors. It’s a civil trial, meaning they could only have to pay fines (and not face jail time).

 

December 2023 (maybe): This is when the government hopes to put Trump on trial about whether he hid and lied about having classified documents after he left office. If found guilty, he could face years in prison.

 

January 2024: In May 2023, a jury agreed he sexually abused E. Jean Carroll in the 1990s, and later defamed her, and they ordered him to pay Carroll $5 million. The day after that verdict, Tump went on CNN and called Carroll a “whack job” and maintained that her story is fake. Now he’s on trial for saying that.

 

January 2024: He’s got another trial in New York over whether he and his company promoted a pyramid scheme while he was hosting “The Celebrity Apprentice.” Trump could be cross-examined and, depending what the jury decides, have to pay fines.

 

March 2024: As the Republican presidential primary really gets going, Trump will have a criminal trial in New York City on whether he falsified business records to make hush money payments to an adult-film star during the 2016 presidential campaign.
