One of the first legal challenges to Donald Trump during this presidential campaign isn’t a criminal indictment that could send him to jail.
It’s a lawsuit by the state of New York alleging he misstated the value of his business to dodge taxes or get investors.
That case is supposed to go to trial next week, and Trump or his business might have to pay some $250 million in fines. (This is a lawsuit, which means there isn’t any prison time.)
But the way these kinds of business fraud lawsuits work in New York is that before a trial even begins, the court decides whether fraud was committed.
This week, a New York judge said it definitively was - specifically that Trump himself committed fraud.
That means Trump and his company can’t do business in New York, and it could make it easier for him to be found liable for huge fines in the upcoming trial ...

Just like (in that story) when Trump went out before all the votes had finished being counted and (somehow) declared himself the winner.
Further to your point - if he was winning (as he claimed he was) why would he want the counting to stop? He's winning (apparently), so he should have had nothing to worry about, right? 🙄

Seeking to disqualify a judge is a challenging and precarious move - one that, if it fails (as it usually does), runs the risk of antagonizing the person granted the power to judge the case.

If you take away the heaping mountain of BS on which Donald Trump built his business empire, what would remain? The former president and his children are about to find out.
In a devastating ruling issued on Tuesday, a New York judge [New York Supreme Court Justice Arthur F. Engoron] asserted the proposition that business fraud is illegal in the Empire State, documented that lying is standard operating procedure at Trump enterprises, stripped Trump’s tangle of corporations of its licenses to do business, and took steps to appoint a receiver to oversee the dismantling of nearly the whole thing: the towers, the mansions, the golf courses, the clubhouses. ...
Interestingly, Trump’s attorneys don’t make much of an effort to defend the fraudulent valuations. Instead, they have argued that banks and insurance companies know better than to believe anything Trump says. Anyone doing business with such a notorious liar had to be in on the joke, as it were. No harm done.
The judge was having none of it. Engoron gave New York Attorney General Letitia James (D) the go-ahead to pull the business licenses of a catalogue of Trump companies, and set about selecting independent receivers to “manage the dissolution of the former LLCs.”
The wreckage of the Trump companies appears to be headed for a fire sale, with proceeds going toward the possible $250 million penalty James is seeking.
