BBC News - Trump seeks to dismiss election interference charges

breaking

Ex-President Donald Trump has asked a federal court to dismiss the election interference case against him, arguing his role entitled him to "absolute immunity".

Mr Trump's lawyers say his attempts to cast doubt on the 2020 election fell within his duties as president and are not subject to criminal prosecution.

The claims were "at the heart of his official responsibilities", they argue. ...

His lawyers argue that Mr Trump's public statements about the 2020 contest were attempts at "ensuring the integrity of federal elections".

This latest dose of self-deluding arrogance is astonishing, even by Trump standards.   😕

Donald Trump is a fuck up. Trump allegedly discussed US nuclear subs with foreign national after leaving White House: Sources - ABC News (go.com)

Months after leaving the White House, former President Donald Trump allegedly discussed potentially sensitive information about U.S. nuclear submarines with a member of his Mar-a-Lago Club -- an Australian billionaire who then allegedly shared the information with scores of others, including more than a dozen foreign officials, several of his own employees, and a handful of journalists, according to sources familiar with the matter.

The potential disclosure was reported to special counsel Jack Smith's team as they investigated Trump's alleged hoarding of classified documents at Mar-a-Lago, the sources told ABC News. The information could shed further light on Trump's handling of sensitive government secrets.

The Washington Post - A catalogue of Trump’s attacks on judges, prosecutors and witnesses

05 Oct 2023

As Trump faces gag orders, it’s worth emphasizing the scale, similarity and viciousness of his attacks:

headings only - the article quotes multiple examples of each. ]

  • He calls them ‘racist’ [if they're Black]

  • He makes claims about their romances

  • He attacks their family members

  • He calls them ‘Marxist’ and ‘fascist’

  • He likens them to something subhuman [if they're Black]

  • He says they are ‘biased’ and anti-Trump

  • He accuses them of election interference

  • He says they are crazy

  • He accuses them of crimes

  • He makes veiled threats

Um actually...

When has Trump gotten his hands dirty when there are so many suckers willing to lose their reputations, or worse, for him,

Trump lawyers tried this before.

You'll remember Judge Engoron, noted that he had rejected arguments earlier in the case, equated them to the plot of the film “Groundhog Day.” He fined five defense lawyers $7,500 each as punishment for “engaging in repetitive, frivolous” arguments.

"That is a fantasy world, not the real world," Engoron wrote in the order.

Two days later: "This is ridiculous," Engoron said on Wednesday as one of Trump’s lawyers repeatedly asked his onetime accountant the same questions for each year at issue in the case.

"All I’m asking is that you lump things together so we do not waste time," Engoron said.

In New York, Rent stabilization is a form of rent regulation; it helps combat the City's housing crisis by making sure some units remain affordable. Almost half of all apartments in New York City are rent stabilized. The max allowed is around NZD $2,250/fortnight.

As you'd expect, rent stabilized apartments valued at a substantially lower market price.

Excluding the fact that your units are rent stabilized is fraud, pure and simple.

Bloomberg: Fake Mansions and Rent-Stabilized Units Emerge in Trump Trial

A longtime executive of Donald Trump’s real-estate company admitted that he regularly included fake mansions and valued rent-stabilized apartments as market rate when calculating the former president’s net worth, wrapping up the first week of the civil fraud trial in Manhattan.

Jeffrey McConney, who joined the Trump Organization in 1987 and is a defendant with Trump in the case, testified on Friday that he added tens of millions of dollars a year to the former president’s annual financial statements for the value of mansions on his Seven Springs New York estate that did not exist.

The unbuilt mansions, valued at $35 million apiece, resulted in $161 million being added to Trump’s net worth annually for several years.

The rent-stabilized units at Trump Park Avenue and the unbuilt mansions in nearby Westchester County are among several groups of assets that Trump allegedly relied on to inflate his value of his assets by billions of dollars a year from 2011 to 2021. The monthslong civil trial is the first of six trials that Trump faces as he seeks to return to the White House.

“You were aware that Park Avenue had these rent-stabilized units when you prepared these evaluations, correct?” asked Andrew Amer, a lawyer for New York Attorney General Letitia James.

“Yes,” replied McConney, the first witness in the case who worked at the Trump Organization and the first defendant to testify.

James alleges Trump reaped $250 million in “illegal profit” by inflating his assets and duping banks into giving him better terms on loans. She’s seeking repayment of that amount as well as a ban on Trump and his sons, Donald Trump Jr. and Eric Trump, from running businesses in New York. The judge already ruled the Trumps are liable for fraud and ordered the dissolution of some of their business entities.

The Guardian - Trump request to halt New York fraud trial rejected by appeals court

breaking

Donald Trump’s New York fraud trial will continue next week after an appeals court rejected the former president’s latest bid to halt proceedings. ...

This was the latest attempt from Trump’s team to stop the trial.

An appellate court on 28 September struck down a request to throw out the entire trial, allowing it to start on 2 October.

Trump had even tried to file a lawsuit against Engoron, though he ended up dropping the suit on Thursday.

James’ office said it was willing to discuss delaying enforcement of Engoron’s ruling until after the trial, and a decision on six remaining claims in her lawsuit against Trump and other defendants – but only if the trial proceeds as scheduled ...

The defendants can continue to try to delay and stall, but the evidence is clear, and our case is strong. We are confident justice will prevail,” James said.

Very accurate!

One of the ones I couldn't see was "something is going on", which probably comes under "We'll see what happens".

Executive Summary:

The Guardian - A guide to Trump-speak: think 'bloke talking loudly in the pub'  (free link)

Trump-speak is typically off the cuff, unconsidered, contradictory, strongly expressed and essentially transitory.

It mixes long-held beliefs and prejudices with barely grasped facts and dawning realities.

It’s like a bloke talking loudly in the pub who “just read this stuff in the paper”. ...

Trump-speak is a thought-stream, not a logical or rational process.

It blithely blunders into sensitive issues. It wings it, blurts and stumbles.

It makes stuff up as it goes along. And it typically lacks solid conclusions.

The crucial thing about Trump-speak is that it is rarely his last word.

I hate to pat myself on my own back, but when the fake electors showed up in DC, but were quickly dismissed as phonies trying to muddy the water, and is was obvious Trump coup's failed, I told those around me "Anyone involved with this fake electors thing is screwed. Not today, but when things calm down, they are screwed."

You may remember that unlike other defendants in the case, Trump did not seek to get this moved from state to federal jurisdictions. The LA Times postulated it was because this judge is a white male, while the federal judge would be an African American woman. Knowing Trump, that's sounds right.

He's screwed either way, perhaps worse in Georgia state court
  • the racketeering Georgia laws, RICO, are more open-ended, less friendly than the federal RICO laws, such having a lower burden of proof

  • there is no pardons in Georgia, till you've spent 5 years in prison

  • Presidents cannot pardon state crimes, only federal crimes

  • Laws were written by civil rights activists to dissuade groups like the KKK, so severe punishments

  • It's likely Trump will be extremely cash-poor after New York city is done with him,

The video below is not unbiased, so a bit optimistic.

Trump screwed again by his own Attorney with new court ruling

MeidasTouch

Trump’s outbursts and contempt for the Justice system is no match for the deadly humor and legal reasoning of Georgia Judge Scott McAfee. Michael Popok of Legal AF reports on the Judge not only ruling against co conspirator Ken Chesebro’s 6th doomed attempt to dismiss his indictment before trial this month, but —ever the law nerd—used a famous comedy sketch reference to pour salt in the wounds.

The Guardian: The Republican party is at last paying the price of its Faustian pact with Trump

More than 11 years ago, before Donald Trump emerged from the primordial ooze of the far-right fever swamp, before the aborted January 6 insurrection and before the latest spasm of Republican extremism felled House speaker Kevin McCarthy, two renowned political scientists, Thomas Mann, and Norman Ornstein, put their finger on the essence of increasingly dysfunctional US politics: the Republican party. Mann and Ornstein argued that the Grand Old Party (GOP) had become an “insurgent outlier” that was “ideologically extreme; scornful of compromise; and dismissive of the legitimacy of its political opposition”.

Eleven years later, the enfant terrible of American politics has somehow got unimaginably worse. The GOP today is less a political party and more an inchoate mass of cultural grievances, conspiracy theories and lowest common denominator political slogans. Trump, for all his toxicity, is a symptom of the GOP’s decades-long descent into madness. Legislating is not seen as a tool for bettering the plight of the American people but rather an opportunity to troll Democrats and play to the perceived slights of the party’s rank-and-file supporters.

But Republican indifference to governing is, perhaps, the least of the party’s pathologies. In slavishly supporting Trump and his Maga – Make America Great Again – supporters, they have empowered a political movement that is increasingly testing the limits of the US democratic experiment.

McCarthy’s political trajectory tells the sorry tale. After January 6, McCarthy, who, along with his political colleagues, was forced to hide from the marauding insurrectionists, turned against the man responsible for the day’s violence. Privately, he told fellow Republicans: “I’ve had it with this guy”. But within weeks, he travelled to the ex-president’s palatial digs in South Florida and, on bended knee, pledged loyalty to the GOP’s orange god. He tried to block a bipartisan congressional committee to investigate January 6 and allied himself with conspiracy theorists who continued to spread lies about the 2020 election. Earlier this year, he gave in to Republican extremists and announced an impeachment inquiry of Joe Biden, even though there is no evidence that the president has committed any impeachable offences.

McCarthy, like countless Republican supplicants over the past eight years, realised that his political aspirations were directly tied to his willingness to support Trump and the extremist forces within the party that have rallied around him. In a tale as old as time, he made a deal with the devil, only to be burned by the political forces he’d empowered.
