In his statement, De Niro cited his experience of playing vicious, lowlife film characters, saying: “I’ve spent a lot of time studying bad men. I’ve examined their characteristics, their mannerisms, the utter banality of their cruelty. Yet there’s something different about Donald Trump. When I look at him, I don’t see a bad man. Truly. I see an evil one.

 

De Niro added: “This guy tries to be [a gangster], but he can’t quite pull it off … he’s a wannabe tough guy with no morals or ethics. No sense of right or wrong. No regard for anyone but himself – not the people he was supposed to lead and protect, not the people he does business with, not the people who follow him, blindly and loyally, not even the people who consider themselves his friends. If special counsel Jack Smith succeeds in his quest for a gag order on Trump, prosecutors could lose one of their best sources of incriminating information - Trump’s mouth. ...

 

I understand why the prosecutors are trying to get a gag order, but they should be a little careful what they wish for, because every time the guy opens his mouth he seems to dig himself a deeper hole,” said Jim Walden, a lawyer and former federal prosecutor in New York, who is skeptical that a gag order on Trump would even work.

Most lawyers tell you if you commit a crime and US law enforcement show up: rule #1 is don't talk to them.

I guess they need to update their advice
  1. If you're trying to overthrow a government, stop. If you win, the leaders will not trust you, and most will hate you. If you lose, everyone will hate you, and the leader will disavow you (unless your leaders is an idiot)

  2. Turn off your smart-phone well away from your crime scene.

  3. you and your partners shouldn't take selfies

  4. if law enforcement show up, shut the f__k up

  5. get a lawyer involved ASAP

  6. lastly, pay the lawyer's bill

This is the legal term for the proceeding that Judge Aileen Cannon held [the Federal classified documents case in Florida] to determine if the lawyers for Trump’s co-defendants may have divided loyalties.

 

A Garcia hearing is held to ensure that a defendant understands their lawyer’s potential conflicts of interest - and that the lawyer may still have obligations of confidentiality to their former clients, even when cross-examining them on the witness stand.

 

Judges also inform defendants at a Garcia hearing that they have a right to conflict-free legal representation and do not have to stick with their current attorney.

Trump clearly has cognitive issues and this has been the case for some time. I would feel some pity for him if he wasn't such a thoroughly unpleasant person, not to mention an aspiring dictator. Fortunately for the world, his mental meltdown will probably reach critical mass before he can do much more damage.

A judge imposed a limited gag order on former President Donald J. Trump on Monday, restricting Mr. Trump from making public statements attacking the witnesses, prosecutors or court staff involved in the federal criminal case in which he stands accused of conspiring to overturn the 2020 election.

 

Mr. Trump’s freedom of speech rights do not permit him “to launch a pre-trial smear campaign” against those people, said the judge, Tanya S. Chutkan. “No other defendant would be allowed to do so, and I’m not going to allow it in this case.

 

But the order left Mr. Trump free as he pursues his presidential campaign to continue disparaging the Justice Department, President Biden - and even to assert that he believed his prosecution was politically motivated. Judge Chutkan also apparently left Mr. Trump free to attack her.

 

The judge did not immediately address how she will enforce her gag order. She merely said she would assess any consequences for Mr. Trump if and when he violates it.

 

Judge Chutkan imposed the gag order at the end of a two-hour hearing in Federal District Court in Washington in what became one of the most contentious public proceedings so far in any of the criminal cases Mr. Trump is facing.

Forbes: How Trump Fooled Deutsche Bank

The New York attorney general is suing Donald Trump and his associates for allegedly lying about his net worth to financial institutions, something he also did for years when speaking with reporters. Why would someone so rich care that much about what people thought he was worth? “It was good for financing,” Trump said in a 2015 interview with Forbes.

Documents submitted into evidence during the trial last week show that Trump’s longtime go-to lender, Deutsche Bank, fell for many of his lies, giving the bank a distorted view of its most famous client.

A Deutsche credit report describing 40 Wall Street, one of Trump’s many buildings, is loaded with errors. “The 72-floor tower consists of 1.3MM SF in premier office space,” the report says.

the building is actually 63 stories, not the 72 Trump often claims. Also it containS 1.1 million square feet of office space and less than 1.2 million square feet of overall space. The square-footage mistake alone could have theoretically caused Deutsche to overvalue the property by about $50 million.

Trump’s lies also affected Deutsche’s understanding of Trump Tower. “The 68-story building contains residential and condominiums that are owned by residents, along with 178,000 square feet in commercial space and 114,000 square feet of retail space,” says the credit report.

But the building does not, in fact, have 68 levels—its floor numbers skip six through 13, tricking visitors into thinking the property is bigger than it really is. It also does not have 114,000 square feet of retail space. An SEC document says it has about 60,000. Deutsche Bank valued Trump Tower at $349 million.

The bank’s biggest miscalculation might have been in assessing Trump’s club collection, composed of Mar-a-Lago, an assortment of U.S. golf clubs and three overseas golf resorts. Trump valued these properties at more than $2 billion. Deutsche Bank slashed that valuation by almost half, listing the properties at $1.2 billion. But the discounted figure was still about $500 million higher than the roughly $700 million Forbes came up with after consulting more than a dozen industry experts.
