Hi Guys,

In a bit of an annoying situation right now, wondering if I can get some assistance

Bought a laptop (HP tx1001au - roughly $2,400 then) back in December of 2007. (normal 1-year warranty).
In June of 2009, it died and I had to fork out $800 to get a new motherboard for it. (3-month warranty apparently)

Now, it's died on me again.

Does anyone know what would be the definition of an acceptable lifetime for a laptop? I'm wondering if I can get something back through the CGA, even though I don't hold out too much hope for it.

I would say you are covered by the CGA a laptop should last longer than that

Just phoned up C.A.B and they told em I can't do anything since it's out of warranty - no help there. :-P

Well considering a lot of laptops at that price point come with 3 year warranties I'd say that you have a strong case that 2 1/2 years is not good enough.

It's probably too late to get your $800. I wouldn't have paid that in the first place, a motherboard needing replacing after 18 months? No way!

Take it back to where you bought it (hopefully reputable). They should repair, replace or refund.

They should be able to find it in the system. As long as you were the purchaser, you shouldn't have too much trouble. Ask to speak to the manager and stand your ground. Try it on getting the $800 refunded too, but don't hold your breath on that one.

Noel Leeming seem to use your phone number to identify you in their system.  They should be able to find it easily enough.

Once they have done that and given you a copy of the receipt insist they refund your purchase price as per the CGA.  It has been fixed once and has broken again.  Obviously the laptop is defective and can not be repaired.

Did you buy it for business or personal use. If you purchased it for business, you are not covered by the CGA. However you would be covered by the sale of goods act. I would say that you should expect a notebook to last at least 3 years, especially based on the price paid and the good quality brand. The CAB gave you bad advice in this situation, if you did buy it for personal use, as you would be covered by the CGA. The warrenty is somewhat irrelevant as you have additional CGA protection

There's never a manager there when you need them, or so they'll tell you.  Surely it can't be the case, someone has to be in charge of the store.

Having said that, a detailed, firm, and formal letter might make them want to come to the party in order to avoid the Disputes Tribunal hassle provided that you can put forward a compelling case to make them think that the Disputes Tribunal would probably rule against them.
