We're getting UFB installed fairly soon at our house (no cross lease or RoW to worry about here), it'll be exciting as it comes to pass.

Indeed. Can't ask for anyone better. He is from Palmy and from Chorus. He knows his stuff which is awesome. And he obviously loves to help! But everyone here has been really helpful. So thank you.,

Update:

-Now have internet with skinny wireless broadband $55 for 60gb. We average 400-500gb a month but again this is better tham sharing my work phone data. Up and down speed is way better than my Vdsl back to previous house (~30/30). I was advised by skinny rep I can sell the modem on trademe as soon as I don't have any use of it. Thanks for the advice on this.

-cancelled my ADSL1 order which was on port wait list to organise fibre. It just wasn't worth the wait.

-now in consent stage on my fibre connection order. This I guess is where it gets tricky. I have our property manager's consent to get this installed just as long as there won't be any digging on the driveway. Fingers crossed, there wouldn't be a need for that. The Right of way consent form still came handy even if it's possibly not applicable to me. Hope to get good news after chorus tech scope visit. I hope it will be user ufbinstaller :)

Thanks all for the time put in helping me out sort this issue. I was very close to desperate. I'm in a lot better waiting spot now than a couple of days back. I hope I can reply to this thread in a few weeks time saying I have fibre connected!

By virtue of where your house is located, you should have it a lot easier than the others down that court. They'd probably have to dig up the tar seal to install fibre to those other houses.

I'm wondering if I'll get InstallerUFB for our install in a few weeks (no idea how many people and vans Chorus has doing that work around Palmy).

Our ADSL2 speed is good and we have a cabinet probably 150 metres away at the other end of the street, but since the UFB won't cost us anything we might as get it now.

This is the email we got from Chorus detailing the install schedule:
"Dear Stuart,
Thanks for your time earlier. As agreed, we’ll meet you at [address removed], Palmerston North on 27/01/2016 between 8 - 12pm to discuss and agree your fibre installation plan. This takes about an hour as we walk you through the install process. Our technician will return to commence the build work from the street to the outside of your property as agreed in the fibre installation plan. You don't need to be present for the build work but you will need to be contactable by phone just in case there are changes to what you agreed to. Sometimes we may be able to complete the build work on the same day as your first appointment or on the day of Install. The final stage of the installation is the completion of your connection to the ultra-fast broadband network on 01/02/2016 between 8 - 12pm. This is where our technician will meet you at your property and complete the internal wiring and installation of the new equipment as agreed in the first appointment. This could take up to four hours. If you need to reschedule either of these appointments, please call us on 0800642726 and quote reference 100271274. Please note that in the event you do need to reschedule, the earlier you can contact us, the more beneficial it will be in terms of appointment availability. We are open from 8am to 7pm Monday-Friday.

Before we meet, please be aware that:

You need to be present to make decisions about the work required to bring fibre from your street to your property. This may include drilling holes and mounting new cables and equipment. You can see our install options on our website.
If you’re renting the property, you’ll need to make sure your landlord is happy to get fibre installed before you sign our installation agreement form. You can .

No update on online tracker but when I rang Spark last week, agent said I am scheduled for a scope visit on the 25th with estimated installation completion date on the 29th. I have not heard from Chorus yet.

How's yours going?

Is that the 25th of Jan or of Feb? 25 Jan is a public holiday for this area.

I got an automatic email today reminding me that the scoping visit is scheduled for Wed 27th, some time in the morning. I assume they'll phone to confirm the actual time the day before or so.

I know that @InstallerUFB will be back from holiday on the 26th, so I could possibly see him show up here on the day (I've met him before, BTW).

Update: Rang Spark and learned that my fibre connection order has been cancelled today due to the "shared driveway" issue we earlier had discussed. Not sure how to go about this now. I have privately message @ufbinstaller. I hope he replies.

I don't undertand this at all. Assuming I have the correct address (reading through the thread), your property is not on a private right-of-way - it is not noted on your property title and the map I obtained from the council indicates it is free-standing as well (see aerial map with boundary lines below.

If you shared the access road (Northbrook Ct) with neighbours, you'd have a boundary line marked similar to below: Note that half the right of way access is included within the red boundary lines, indicating it is a shared right of way with number 51. THE OP DOES NOT HAVE THIS...... to me, Northbrook Ct is a LEGAL RD, not a private driveway, therefore there is no consent issue.

If the OP sends me the details of his Spark order or account number, I will look into this as I believe mistakes have been made.

I stand corrected,

I called Palmy Council who confirmed that whoever owns 3-5 Northbrook Court (one title) has also secured exclusive ownership of the entire road known as Northbrook Court.

As such, without their express permission, no fibre cable can be installed on Northbrook Court. I can't see why access cannot be gained direct from Upham Tce if copper is already entering from there. I'm happy to discuss with Chorus if the OP wants me to.

I don't know all of the legal technicalities around telecommunications.

However, if this dwelling already has a telecommunications easement for the property, and I assume that it must do because there's already a conduit with a phone wire (in the above pic) does that mean that this easement can be used for other telecommunications services?

Is it a simple yes or no? Or is there more to it than that?

Simon, many thanks for looking into this issue. Rather than a private message, I'll provide the details you need in this thread:

I've rang Spark again and the agent I spoke with said he will put in another order noting that the copper entry point is from the side facing Upham Terrace and not Northbrook Court. I am still waiting for an order number as he said he will email it to me so that I can ring Chorus and use it as reference to my order. When I rang Chorus (before Spark), they said to ring Spark. The agent I have spoken with is adamant that regardless of where the copper entry point is, a consent from the other neighbors is still needed. They have also said my address is not included into the group of addresses that need ROW consent. This has confused me all the more.

I have a feeling that Chorus may have just straightaway rejected this order possibly without looking it may be a special case. It may have been filtered just by the "Northbrook Court" address.

I don't know how to communicate with Chorus or Spark if I am not given a venue to explain before the order is cancelled. So I am grateful that people, like yourself, take time to look into this and may get it further than consent stage.

Two things that should be looked into by both Chorus and spark:
1. Copper entry point is on Upham Terrace side and installation can be done direct from Upham Terrace without the need to do any work in Northbrook Court
2. 30 Upham Terrace and 1 Northbrook Ct are on the same lot area. Is it possible this was my address way before Northbrook Court existed? However, 30 Upham Terrace I was told does not have fibre available which I find confusing.
3. Property manager has allowed me to have fibre but only signed the ROW form. I was told on this same thread Chorus will get that consent after a scope which unfortunately I didn't even reach.

Yes, I thought it was just as simple as that. It's either that or maybe it's just one of those that get rejected straight away because it is "Northbrook court." Or maybe it's more complicated than that. Maybe some system just overcomplicate it.
