Happy New Year all! 

We still don't have internet in this house we moved last Dec. It didn't work out with 2degrees so I switched back to Spark VDSL. Then I was informed I can't have it (address checker said I can). Thus, I was moved to ADSL1. Still not connected as I am on port waiter. Waiting sucks. I've been backreading and it seems like there's not much I can do but WAIT.

With a little bit of hope, UFB is available in my area. There's a hold put on our address as there wasn't any consent from building representative. I rang the property manager (yes, we're renting) and he said does not have any problem signing one off. Great! 

My question is regarding consent from neighbors on shared driveway. I was advised by Spark to go house to house and pass on the consent form. I don't mind doing that but before I do so, can any one confirm it is really necessary? Photos below:

 

I hope to hear from you. It's been frustrating not having internet at home.

From Google Maps aerial view, I would think 28 Upham Court has it's own standalone driveway (no consent required for that property), and the shared driveway for Northbrook Court needs consent from the other houses down that driveway.  Do 873A, 873B, 869B or any other houses use it for access?  - https://goo.gl/maps/fEMeAQ5Acww

I have not really gone down for a walk to check. May do that this afternoon. But then again, me being the first house in north brook court and along Upham terrace, do I need to get the consent of everyone else up the driveway? As to my understanding, I would need to if I am "up" the shared driveway which I am not.

Hi Rudi,
Yes, you'll have to get consent from all the people you share the driveway with. Looking on http://geoguide.palmerstonnorth.com/ there are houses 2, 4, 6, 8 in your court.

Unfortunately until the law is reformed (don't hold your breath), you'll have to go thru this red tape bullcrap.

And yes, all the rest from Northbrook Court (1-8) use this shared driveway. I was told some houses inside don't use and have a different driveway from the other side which is hard to see from google maps aerial view.

You know what's weird? 30 Upham Terrace on the map is in the same area where I am. Can't see that anywhere close.

You normally need consent from everyone on the shared driveway, your situation looks a bit complex with some empty plots also on the shared driveway - might have to go to council to find out who owns that land if you want to speed up the consent yourself.

On this video, https://www.chorus.co.nz/rights-of-way-1/rights-of-way/rights-of-way-and-cross-leases, at the 30 second mark it says consent may not always be required for the house nearest the street, if the install can be done direct from the roadside under your fence, for example.

I see. Well, I have printed 10 consent forms already ready to be sent out. I guess, I was hoping it is not necessary as I think they can provide fibre without having anyone to work on the shared driveway as they can access my house from the street (Upham terrace) just like my neighbor across who has UFB already.

Where is your current copper entry point?

Is it on the front facing the driveway, or on the side facing the street?

According to the Palmy counil the water pipes for you place come in straight from the upham terrace ( not up the driveway)- I would not be suprised if the phone line did the same thing,

If it does enter directly from Upham, you will not need to wory about a shard driveway consent as the connection will simply run under the "front" fence facing upham terrace....

Is there a UFB pillar or one of the newer flat profile round connection things outside on your footpath on Upham Tce? I guess you could try to get Spark to see it your way if there is. It's worth a shot. The worst they can do is insist you get consent from the neighbours.

I think I found the copper entry point. This on the side of the house facing Upham Terrace. Photo below:

In the second photo, there is a small green UFB box right against your fence property, to also allow connection direct from the street. You should be able to contact Spark and ask them to contact Chorus to investigate connection without shared driveway consent needed.

I've seen a few of those on footpath just outside my house. The photo below is just right outside 28 Upham Terrace which is the house across the "shared driveway":
