given that 4G is only In the main centers and there ant any phone out there that uses the 700 mhz band yet even a roll out you think they would allow you to use there 3g to the fullest or is it just me

Maybe it's so that they can come up with a marketing message that says something like 'up to 10 times faster than 3G'...because they have reduced maximum 3G speed to well below what it is actually capable of.
If they compared it to DC, then it would only be something like 'up to 3 times faster' which isn't nearly so amazing sounding.

occams razor would suggest that it is more likely the Ts and Cs are a typo. (i.e. they actually mean Mbps, not MBps
1) If it was 'limited' to 14.4MB/s then this would be 115.2Mbps, as you say. However, since 3G (even dual carrier) has a theoretical maximum of less than half that (42Mbps), what would be the point in putting it in the Ts and Cs? Might as well say speed will be limited to 1000TB/s 2) furthermore, 14.4Mbps is the max theoretical speed for HSDPA, and therefore is the max speed of phones like the iphone 4. 14.4MB/s is never used in any technology that I can think 3) Bandiwdth speeds are measured in Mb/s, not MB/s. To put it in MB/s is going against the standard notation for bandwidth speed
so either they purposely added in something to the Ts and Cs for absolutely no reason whatsoever, using the wrong technical notation, and picking a number that just happened to be the technical limit for HSDPA but swapped it for Mb, or the lawyer simply wrote MB when he meant Mb.
I can confirm that the "MB/s" is a typo, and I agree that the blame probably lies with our lawyers :-) We are changing this now to "14.4 Mbps".
All Red packages (Red Essentials, Red and Red Super) come with 4G and are not rate limited on 3G or 4G.
The plans which are covered by the 14.4Mbps clause in the Terms & Conditions are:

May I ask why you are rate limiting all these plans? Your supernet advertising talks about how you have the best network, yet you are intentionally limiting the speed for 90%+ (my guesstimate) of your current subscribers to well below the speeds your competitors enable.
As for your ADSL speed being only 14Mbps, maybe you should upgrade to Vodafone's 'Supernet' VDSL at home?
Can someone give me some clarity as to what the "New phone every year" actually gives you. There is a mandatory trade in of the old phone. How much is that worth? What model of new phone will I get? It's very vague in both the blurb and the T&Cs. I want to know for sure that I will get like-for-like (or something even better) when the time comes.

Sounds to me like it's just a case of "We'll give you the 24-month contract bonus ($X off a new phone) every 12 months if you re-sign"
