good point why would they do this as they haven't fully upgraded there network to 4G LTE ???:(

given that 4G is only In the main centers and there ant any phone out there that uses the 700 mhz band yet even a roll out you think they would allow you to use there 3g to the fullest or is it just me

Maybe it's so that they can come up with a marketing message that says something like 'up to 10 times faster than 3G'...because they have reduced maximum 3G speed to well below what it is actually capable of.
If they compared it to DC, then it would only be something like 'up to 3 times faster' which isn't nearly so amazing sounding.

I can confirm that the "MB/s" is a typo, and I agree that the blame probably lies with our lawyers :-) We are changing this now to "14.4 Mbps".
All Red packages (Red Essentials, Red and Red Super) come with 4G and are not rate limited on 3G or 4G.
The plans which are covered by the 14.4Mbps clause in the Terms & Conditions are:
$29 BYO SmartPhone Plan
$39 BYO SmartPhone Plan
$59 BYO SmartPhone Plan
$39 plan on a 24 month term
$59 plan on a 24 month term
Business $35 - BYO Smartphone Plan
Business $45 Plan- BYO Smartphone Plan
Business $60 Plan- BYO Smartphone Plan
Business $45 Plan on a 24 month term
Business $55 Plan on a 24 month term
On these low cost plans 4G is not included, and only on these plans is 3G limited to 14.4Mbps. Customers on these plans can buy the 4G upgrade ($10/mth incl GST) which provides both 4G access and removes the speed caps in 3G areas.
I would like to point out that 14.4Mbps is the best speed I get on my home fixed DSL broadband connection ... so it's still fairly quick!

sbowness: Can someone give me some clarity as to what the "New phone every year" actually gives you. There is a mandatory trade in of the old phone. How much is that worth? What model of new phone will I get? It's very vague in both the blurb and the T&Cs. I want to know for sure that I will get like-for-like (or something even better) when the time comes.
