no your paying for a broadband connection, here's something i found under the terms and conditions

6. Speed and Usage of Services

6.1You acknowledge that statements about the speed of the Services are not guarantees about continuous speed of your Speed Plan. Where a download or upload speed is specified, the Services are capable of burstable speeds up to the speed stated. Where a download or upload speed is described as Maximum
you will receive the highest speed your broadband connection can deliver. The actual speed your broadband connection can achieve will depend on a number of things including the condition of your telephone line, the distance from your telephone exchange, the equipment you use (including your computer), the time of day you are connecting and the Internet use by others connected to the network at the same time as you.

Service providers guarantee their services will be:
  • Performed with reasonable care and skill.
  • Fit for the particular purpose they were supplied for.
  • Completed within a reasonable time.

The contract I have with Telstra Clear is that they will provide me with internet access, a data cap of 60GB per month, 15Mb/2Mb download/upload caps. That is the plan they *advertise* and sell.


The service I have had over the last 2 days has NOT been "Fit for the particular purpose they were supplied for."


Nothing in the Telstra Clear contract I signed up for and pay for overrides the Consumer Guarantees Act.

I'd like to say a big thanks to TCL.

Sure my speeds were down. but still usable. Downloaded 66GB over FTP from 10am Saturday until midnight last night. Surfing during that time was fine and I watched a HD episode of Tekzilla on Sunday - just paused and let it buffer to 5% instead of my usual 2%.

I realize that the people that had a bad weekend will be unhappy but I'm sure that for everyone of them, there are 1 or 2 people that are perfectly happy.

Its the first time at this for TCL. I'm sure they will make some changes if they do it again.

And as I said earlier to someone else, you'll find the service is provided on a "best effort" basis - no speed/throughput/service level is guaranteed. However, if you complain, you may find they'll probably offer you a credit of some sort.

And just in case you missed a typical speed I was getting over the weekend

 

Now, is it really fair to say that what I was getting fair use of my broadband connection over the free data weekend?

Why do people just think we want money back, I don't want a credit, I want to be able to use my broadband connection when I feel like, and not have that ability taken away by a silly offer that was always bound to be abused and cause problems for at least some peoples connections!

I to would be fair to say I have reasonable expectations of my broadband connection based on passed experience, if I always had poor performance like this I would not have stayed as a TelstraClear customer, so I do not think it fair that they give a 'free data weekend' when their network definitely cannot cope!

I would hope that you, or anyone else would understand that taking service to such a low level for some to provide to others is unethical.

Agreed completely...I now have a telecom box close to my house, so if TCL try this again I will switch!!!

Consume app for iPhone. It doesn't monitor my connection, just grabs the data from TelstraClear (plus lots of other accounts too)

Arghh, posted this in the wrong topic earlier today:

Another note, related to this topic that may be of interest... Cheap, low performance or faulty routers (something Don found out when his 15 Mbps line was not doing more than 7 Mbps - limited by the router).

I have two routers here: the a 100 Mbps Cisco SRP 521w router and the new Cisco (Linksys) E3200, with gigabit ports all the way. Neither are cheap though, with RRP over $300 these days.

This morning I ran a speed test and got 15 Mbps (on a 100 Mbps-provisioned DOCSIS3 line). I decided to reboot the E3200, and speeds are up to 80 Mbps again after the reboot. I suspect too many connections may have slowed down the router. Never had this problem with the Cisco SRP 521w.

Can I ask you guys, was this stuff you wanted to download/upload or did you just get it because of the free data weekend? If it is stuff you wanted/needed to do, what would you have done if there wasn't a free data weekend? Would you have paid TC the overage charge above your normal data allowance?

We have a 120 GB allowance, and lately have been using about 80 GB of that. I needed to download about 80GB of virtual HDD from the Geekzone server, as well as upload about 10 GB of a new folder to Crashplan.

If it wasn't for the free weekend I would end up paying about 50 - 60 GB extra usage.

Makes sense, and I can see why you would be doing this, good to see you got some good use out of it and managed to save money that you would have spent.

I wonder how many others would have been using their data to this extent as well though and would have paid these charges anyway but were lucky that there was a free data weekend to save them the cost?

In my case, I didn't plan to download anything but after finding my gaming impossible I figured "when in Rome" and decided to download Linux to see what all the fuss was about.

(For what it's worth, it kernel panicked on boot).

I pay a lot of overage, I use between 150 and 200GB per month on a 90GB plan. I chosse to pay as I dont want to limit my internet use. In saying that though I did take this as a chance to clear my seedbox out.
