What was even "wrong" with the phone? I'm lost now. if it was less that 2 weeks old, the store should have offered you a new handset really. MFR have has some "big" changes of recent, but in MFR's defence, Pacific Retail stores aint the best at technical stuff, or getting stuff sorted in a timely manner. They are better at selling the stuff (forced down your throat)

I'm suprised that they actually booked the phone into repair. Lately I keep coming across instances where they just sent them 'Telecom' or 'Vodafone' store.

It's just a run around for all....

Not to be rude or anything, this should of been raised with the manufacturer, most Phone Manufacturer's have representation in each country, either them selves or a third party, at anypoint this should of been treated as an out of box failure, most companies allow between 7 to 14 days for this.

If it is a firmware problem, the this would be treated a normal Warrantable job, I suggest contacting your local phone manufacturer, or taking it up with your Service Providor.

Another thing that could be holding it up is that the current Firmware could (Not saying it is) be dodgy. There is Firmware out their that does not agree with the GSM Network and then their is a battle between the manufacturer and the service providor who will correct this. I see problems like this all the time.

In any case you should still take it up with the Mobile Phone Manufacturer Customer Care Division, Generally they are quite good to deal with (In most cases that is, there are exceptions)

It would be a good idea to read you Manufacturer's warranty card regarding O.B.F, if still have questions ring the manufactures customer care line.

Well in hindsight there I could have gone about things in many different ways (isn't that always the way), but since the phone apparently is fixed and is on the way back there isn't much I can do. I will remember for next time though. Might help some other users too

You can call the manufacturer certainly, who will tell you what to do, but to claim an OBF you need to go to your retailer anyway, which is what the manufacturer will refer you to do.  And Warranty cards do not discuss OBFs, which are network-related and therefore subject to change without notice. 

If you wish to claim an OBF (or ELF), it is at the dealer's own risk, for example if the phone is damaged, and if they send in an OBF claim on a damaged unit after swapping in store, they're screwed, so be aware that even within 14 days you may find yourself sending the phone in for repair.  It just depends if the dealer wants to touch it or not.

Software reflashes failing is almost always due to some sort of IT issue with your computer that conflicts with a) the connection with the server or b) the USB connection with the phone (often a firewall deciding to block an FTP port).  So I'd advise not to software update your phone on that PC again.

If you walk into Mobile Fone Repair in Mt Wellington, you can often get while-you-wait service.  Just call before you head on down to see if they're busy and if they're doing counter jobs that day.
