dejadeadnz: This is quite possibly less than 3 years old. If it's for personal use, I'd say the CGA and its requirements in respect of goods being of acceptable quality has you more than covered.




Even if it was older, if it is a known fault that could develop, it should be covered too, as goods must be sold free of minor defects, and this isn't really minor either. Many companies will issue recalls when they identify a fault with a batch (eg car manufacturers), while some will only fix peoples goods that are affected over time, if they don't think it will affect everyone who purchased from the batch.

I was rung by the service folk who advised Apple have declined to assist. I rang Apple and was at the point of giving up when Apple advised that the don't recognise NZ law, that was like a red rag to a bull for me, battle has been joined.

That's exactly what they are relying on...  you to give up and go away.

They charge GST.  The company is registered in NZ.  They are subject to NZ business law.  There is no wiggle room.

This should be a good one then. Take 'em down.

Everytime I've mentioned the CGA for issues with my own or friends/families Apple devices, apple doesn't mess me around. So not sure why they've suddenly changed stance. Didn't they recently get pulled up about this in Australia too?

Thats interesting. Norway has much the same laws as NZ and just mentioning the norwegian CGA is like having a secret password that makes them honor it. Strange that they are not doing that for NZ law, I say take it to the Commerce Commission - they should be able to get Apple to see the CGA light.

It's strange that their phone support people don't recognise NZ consumer law, yet their web site does:

This is my experience too. As soon as you mention "New Zealand law & the Consumers Guarantees Act" the whole conversation changes, and they happily skip to your beat.

Get their position in writing and then report them to the commerce commission. For them to say that I believe is potentially breaching your consumer rights under the fair trading act.

I still have not heard further from Apple, maybe they know my medical condition is flaring badly and I really don't have the mental or physical reserves to fight.

Aren't they a NZ listed company? If you check the companies website find their office address, and write the a 'letter that gets results' from the consumer website.
