and to get a custom unit built from the manufacturer, you would need to be ordering thousands, not a few hundred units to cover a raincheck.

Sorry, what I meant is that the simplest explanation may often be the correct one, and that it's much simpler to buy units from ASUS (oops! I wrote Acer last time), rather than have ones made up, I'm sure the salesperson was probably just sayin stuff without knowing.

LZ: Just spoke to my local HN store and they confirmed that it will be an ASUS with the exact same specifications are the HP mini has. I assume that means every spec including size and weight although there might understandibly be a few grams and centimeters in it. It will be black in colour - for those who care about colour. The estimated arrival is about 3-4 weeks. I asked about the model number but they suggested these were being built to spec for HN and so it was not any published model number.

Overall it sounds reasonably good however I find it hard to believe that ASUS would assemble a device especially for HN. Anyone else have any joy getting any kind of commitment on what the model number is?

Yes, it seems highly unlikely to me that they are building a machine just for this raincheck fufillment. That would require ASUS altering their website to provide drivers/bios, etc for some special model. Just seems like a lot of effort on ASUS's part for bugger all return.

I think it's more like that the salesperson at HN is just telling a story to make the delay sound plausible. Let's face it, most sales staff in most chain stores in NZ barely know what they are talking about most of the time.

I haven't been contacted as yet, but have paid the money. I'm not so worried about the delay, provided the netbook proves to be worth the wait. I was assured of a refund if I'm not happy with the substitute product and that's where I sit on it at the moment. If they call and ask me to commit to it without providing accurate specifications, I will be declining. They may feel the 1008HA I already mentioned is the "exact same specification" as the HP. In my opinion, it's not.

Anyway, they need to stump up with more info. It would be in their best interests, especially if they are having them built specifically for the raincheck. No point in making a bunch of these things if a quarter of the people end up asking for their money back as the replacement machine is not really of equal quality to the HP.

Agreed - I think it would be in HN's best interest to be a bit more forthcoming with the specifics of the replacement model. I think if there is nothing substantive by close of business tomorrow then it's probably worth a follow up especially since I'm presently extending an interest free loan to HN for 3-4 weeks! :)

They told me 'at worst' by the end of Jan, so if it is delayed and I don't think the model they offer is acceptable, I will be complaining to the ComCom

The Asustek netvooks appear to be about an inch deeper than the HP minis, which means that they are quite a bit bigger, and made from cheap shinely black plastic around the touchpade and keyboard which becomes a finger mark trap when typing. I personally am not going to accept an Asustek instead of an HP. It is like paying for and ordering a Sony TV and them prodinf you with a Panasonic. I don't like Asustek laptops after as I have owned one beforeand their customer support was very poor and the laptop faulty. If HN are going to try to pull this trick, the specs should be substantially better, to compensate on the cheaper lesser brand, and the fact that they aren't supplying what we ordered. There is no reason they can't provide the Hp mini which they are contracted to provide , to almost the same specs,but with win 7 instead of xp.

If it is going to take a month, the are going to need to issue new tax receipts otherwise we may get less than 11 months warranty. The warranty usually begins the day you pay for the item.

The only way legally I believe HN can get out of providing HP mini branded netbooks us if HP gas stopped making them, which they haven't. There reason for getting Asustek would be solely for cost reasons and this solution would be the cheapest for them. Personally I want the HP for it's special syncing software which should make it easy to sync the PC to it

Everything you have said is entirely opinion-based.

The Asus are not any cheaper generally, especially when pricing is model-specific, and the 'lesser brand' of Asus has been rated as the higest quality/lowest failure rated notebook for several years in a row.

I'm sure if you're not happy with the product they have offered, you could just go get your money back instead of complaining about the solution they have offered. Its a $288 netbook after all, you won't get a deal like this again for a while.

You could pursue it all you like, but I'm guessing you won't end up getting an HP out of it, you'd just end up with your money back.

you paid for an HP 110-1111TU or whatever the model was, which they will have stopped making (indicated by the fact it is an XP model, and their new ones will be Win 7 with a different model #).

Sounds like it'll be the 1000HA with 3-cell. Just make sure it's defnitely the N280 version not the N270 :) Be a great device for a great price if that's the case. I'd definitely take the Asus over the HP

Asus are looking at ditching most of their current models I think, as are most others to make way for the N450s and other Pineview related products like the 1005PE

I have moved across the ditch. Now residing in Melbourne as a VOIP/Video Technical Trainer/Engineer.

From the Fair Trading Act:

A retailer can offer you a 'raincheck'. This means the shop will get more of the product they ran out of or a product of similar quality and value and sell it to you at the special advertised price. It's a good idea to ask for a raincheck.

this is exactly what they have done. I believe if you are not happy with the replacement option, then you can get your money back, but by no means do they have to provide you with the model that you want, as long as the model they are offering is of a similar quality and value, which it is (despite your opinions of Asus). If you went through the courts to argue otherwise, I'd say you'd lose and have wasted more of your own time and money.

A contract is a contract.Legally they are required to provide whati ordered or negoiatet with me in an alternative. The price is irrelevent. Maybe they have stopped making that exact model number, but inthat case theywould legally be required to provide a netbook of the same brand but the updated model at the same price. If they weren't going to do that, they should never have demanded us pay for it when we ordered it, which legally enters them into a contract to provide the goods or services. I was never told when I ordered it, that there was a chance that I wouldn't even recieve the actural brand I purchased.
