Sloth, to correct you it wasn't actually a rain check, but a backorder. My tax invoice when I paid for it states on it that it was a back order for on HP mini

I don't know how a rain check differs, but I suspect a rain check is when they just put you onto a list and you don't pay until the goods cone in.

In that case I look forward to reading about your progress through the court system to get the model you want. Not trying to come across as an ass, but I don't believe you will get what you are asking for any other way. And after you factor in the time involved and associate a cost with that, you'd be better off just getting a refund.

Yeah, I think either accept the Asus or get a refund.

the Asus netbooks are great. You may not like them, but they are the most popular netbooks on the market. They aren't more than 1" thicker than the HP, more like about 0.2" for the 1000HAs and the 1005/1008HAs are thinner than the HPs.

The whole Panasonic vs sony thing is a bit silly. Panasonic make better Plasmas than Sony ever could. And Samsung make better LCDs than both :)

You won't have much luck taking them to court over the invoice at all. You could try it, but you'd end up losing the case I would think and then you'd be spending more than a full price netbook to pay the court costs

Similar quailty and specs would Usually mean the same brand, but a different model. Disputes tribunal costs about $40 so minimal if a few people pool together. However I am sure that HN management would resolve any disatisfaction before it got to that. As we don't yet have the facts on what is actually going to be provided it s still speculation but the product does also need to be provided within a reasonable time period. An entire month does sound extreme.

If it's a 1005HA it'd be awesome

But as the Harvey Norman NZ page says "they have sourced an Asus with the same specs, delivery expected first week of Feb. "? Just got asked about it via DM. Thx"

vinnieg I said they are about an inch deeper. Eg from the front of the touch pad to the back of the keyboard. The thickness is probaby similar. This makes them a lot more bulky than the HP minis. You don't know the exact model yet but I suspect they may supply the slower 270 chip which is on the older models that more closely match the HP mini specs. I guess until we know the actual specs we can't really comment. HN should offically tell us on their Twitter page or on here what the real story is.

yeah they should supply you with the N280, if they don't, I'd definitely complain and ask for the N280

is that the official definition by law? if not, you'll get nowhere with that in front of the DT.

As it stands, and from the information we have, the Asus is "similar quality and specs".
You would need to prove otherwise, and not just "i don't think it is".

Where is the information on their website about the raincheck?

I think the major trouble in court would be just that an invoice is not considering a contract. So Harvey Normans have the full right to refund just by saying "out of stock". Unfortunately that's the way the CGA works

Sloth obviously it is all subjective. Comparing quality of brands is almost impossible which is why when a company is not able to provide a specific model they will almost always provide an alternative model under the same brand. I have never come across a company selling you a particular product and then providing you with a totally diffent brand altogether. It is like ordering a BMW and then being provided with an Audi.
It does appear that some people have done backorders and prepaying for it, while others have rainchecks and just had their name placed on a list where they don't have a contract so perhaps they are treating these differently.

In that vase it was for a brand of bed where the retailer had broken their relationship with their supplier so they were unable to source the product through that supplier. They were required to source the bed from another supplier.

and if the bed was not available from another supplier? as is the case with the HP, as the model is EOL.

I have never seen anywhere that they specify it HAS to be the same brand. you have the full right of refund however if you aren't happy with their solution.

I guess it is hard to tell if you're happy with their solution if you don't actually know what their solution is. Beyond telling you it's Asus and that it has the same spec (still to be confirmed) they have not really said anything.

HN - come out and tell us what the model number.

Well I would be quite disappointed if it were an Asus EEE 1000 (any of the 1000 derivatives - H, HA, HE etc). I think they are too chunky and the screen bezel (surround) is too wide, when compared to the HP Mini 110.

I feel that HN need to supply any one of Asus EEE 1001, 1002, 1005 or 1008. These machines are more in keeping with the size and style of the HP Mini 110.

Also, wouldn't it be nice for HN to 'over-deliver' (i.e. exceed everyone's expectations) on this issue to help save face and win-over it's customers? This means one of Asus EEE 1001, 1002, 1005 or 1008 to me.
