sbiddle: Kathmandu used to be the worst offender when they started source tagging all their goods and not bothering to deactivate tags correctly st stores, and for a long period of time weren't doing any deactivation of goods from their mail order (something I blogged about here). This type of attitude ruins the whole integrity of the EAS system making it pretty much worthless for any retailer trying to use it.

I think there was a separate problem for Kathmandu - they used to sew some kind of "echo location" tag into their clothing labels that was intended to be used by mountain rescue crews to detect people who had been buried by avalanches, and these tags were setting off retail security systems. I know I set off the alarm going in to The Warehouse in Queensgate, Lower Hutt while wearing a Kathmandu jacket that I had owned (and had removed all store tags from) for about six months. On this occasion I was asked by someone at the door if they could look in my bag and I was happy to comply - I didn't have anything to hide. The alarm went off again as I left and the same staff member just smiled and waved me through. Although I consider myself an honest person I couldn't help thinking what a great opportunity that would have been to nick something!

Athlonite: If the person stopping you is not the police or does not hold an current C.O.A (certificate of authority) then they have not right to detain you or search your belongings

it is illegal to act as an security guard without an current COA

A store employee acting on behalf of the owner/operator can stop you. They don't require a COA.

Back when I first started out in Security (part time as an 18 year old fresh out of school) I did a bag search on a teenaged male. He was almost to helpful and receptive, taking his bag off, unzipping all the pockets and holding it open for me. Contained within the main pocket amongst the usual school books etc was several adult themed magazines in all their glory. To this day I'm not sure what was in the other pockets...

Ah they do now since the new laws came in around acting as a security guard, without a COA your not even allowed to to do bag searches anymore

Some interesting points on the NZ Police website about all this

https://www.police.govt.nz/safety/business-crime-prevention.html#shop-theft

Answers many of the questions in this thread.

In a similar vein - I have an older Mazda, in reasonable condition but it does have the original factory rubber spoiler on the back.

got pulled over a few times in it - never any charge.

However one night handed over my license as requested and politlely said "May I ask what the problem is officer." - to which he replied I had been speeding.

Now the above reply was complete bollocks!. I had been doing 30km in a road work zone and know it was 30km because the car behind (the officers in question) had been tail gating me so closely I could not see their headlights in my back mirror (filthy bad night of heavy rain in a dark area of a Chch road at 11pm after work really peeved my off). I had seen it was a police car and knew i was being baited into speeding up  in the road works zone. I stayed smack on 29-31km according to my speedo and GPs and did not move off that speed even when the road widened prior to getting to the 50km and end of road works sign.

As angry as i was i kept my mouth shut, and submitted to the REgo, WOF, license, breath test / interrigation I was presented with. no ticket was given and again I kept my mouth shut about asking him to ticket me for speeding knowing he couldn't.

It seems to me that sort of situation has a lot in common with the poster in terms of being detained (without cause or suspicion ). It definitely peeved my off enough that i am still angry about the treatment six months later and it has set me on the path to knowing what my rights are. like the poster I feel bullied and was definitely harrassed based on profile (Mazda = pulled over, family honda odyssey = never pulled over).

The way things happened to me has made e far less co-operative and far more pugnacious in the face of police pulling me over / random checks etc. I suspect the warehuse will face similar reactions from the posters wife.

I know police need to check and detain to do their job. I know that the warehouse do need to do checks to keep their secuirty nad stock theft working, however how it is done - that's the key. friendly co-operation is very possible but not where people feel intimidated, threatened and harrassed.

I got pulled over _so_ often in the skyline, and never in the falcon. Guess its all about appearances.

What are you saying about the OPs wife!!! (She's a bit older, but she can still party with the best of them!??? LOL)

OT, but it really annoys me that the police lie as to why they pull you over. They should be upfront and honest about it if they want to keep the respect of the NZ public. If they pulled you over randomly, then they should tell you that, otherwise all that is happening is people are losing respect in the Police.

I've been in that situation also - and if the cop actually saw what he gave as the excuse as to why he pulled me over, then he needed to be alcohol and drug tested!!! Cops should not be hiding behind lies. Period.

I've always been told random vehicle inspection when pulled over.
