I am not sure what they are expecting in terms of being without one, but I guess they are thinking it wasnt for working for months before they took it away etc.  Family member who doesnt live that far away is helping out.  They never offered a loan machine, but they never initiated any of the service.  I had to ask for a refund and that they fix it for free etc, so I can I only see is that you get what you ask for. 

 

30 days seems unreasonable to me, - did Samsung provide a loan machine?  Year ago, F&P provided a loan fridge when the fridge broke, so I guess its not off the cards.

Yes a loan machine given if delay of more than a few days  in repairs & one being available but regardless the 30 days applied whether a loan machine was supplied or not.

The more I read on this thread, the more I will just keep on fixing my old F&P machines. Despite all of their flaws. Im just waiting for water to start leaking from the water cooled main controller in the 24 year old machine. It's not if but when that water will leak onto the circuit board that that carries 350VDC. And if I ever do need to buy a brand new washingmachine, I will now be seriously considering buying a F&P.

 

 

If it does crap out (controller board) and it's the green case model, PM me - I've got one sitting here that I tried to sell on TM with no takers - possibly because it was a reconditioned unit (professionally by Recon Modules). Free or exchange for bottle of wine, whatever.  I did sell other salvageable parts with no problem.

 

I kept our F&P going from 1993 until a few months ago.  Was a bit like "my grandfather's axe" though, had replaced many parts, the bearings and seals had gone again.  Time to call it quits.

 

I did replace it with an F&P, actually a front-loader, after discussion with a few people in the repair trade. I understand that F&P had some "issues" up to 4 or 5 years ago, hopefully sorted now.  They do seem to maintain parts availability long-term, although I do have an annoyance in that their parts folks won't automatically give me trade price for cash sale when I turn up wearing overalls like they used to do.

 

 

 

 

Thanks for the offer @Fred99 But the older machine uses the light blue controllers. And the newer one uses the brown coloured air cooled controllers.

Just got update from Bosch, but I am not getting a sense of urgency

 

 

 

"The part has been received an allocated to the technician.

 

 We will be in touch as soon as the technician has had a chance to work on the unit. I cannot give a time at this stage, but will continue to monitor."

 

 

 

They seem to be leaving it open ended - I asked for a loan machine if they could not deliver this week, but they did not address that question, ie they have ignored that request.

Consumer Gurantees Act - Section 19 is below.  Does the text under number 2 mean that the warranty period starts again?

 

 

 

 

19 Requirement to remedy

 

 

 

(1)

 

 

A supplier may comply with a requirement to remedy a failure of any goods to comply with a guarantee—

 

 

(a)

 

 

by—

 

 

(i)

 

 

repairing the goods (in any case where the failure does not relate to title); or

 

 

 

 

(ii)

 

 

curing any defect in title (in any case where the failure relates to title); or

 

 

 

 

 

 

(b)

 

 

by replacing the goods with goods of identical type; or

 

 

 

 

(c)

 

 

where the supplier cannot reasonably be expected to repair the goods, by providing a refund of any money paid or other consideration provided by the consumer in respect of the goods.

 

 

 

 

 

 

(2)

 

 

Where a consumer obtains goods to replace defective goods pursuant to subsection (1), the replacement goods shall, for the purposes of this Act, be deemed to be supplied by the supplier and the guarantees and obligations arising under this Act consequent upon a supply of goods to a consumer shall apply to the replacement goods.

 

 

 

 

(3)

 

 

A refund referred to in subsection (1)(c) means a refund in cash of the money paid or the value of any other consideration provided, or both, as the case may require.

My understanding is... 

 

If the product is repaired then the original warranty & obligations under the CGA continue.

 

If a product is replaced then the terms of the original warranty & CGA obligations continue to the new product but are applied as from the original date of supply of the first product.

 

However the replacement must still be of merchantable quality & see out the original expectations of the CGA.  If not then you still have a potential to claim for repair or replacement.

 

Best option if available is for full refund of cost of original product with which you purchase a fresh new product with a fresh manufactures warranty & full rights of redress under the CGA.

That's what I would have thought but a friend of mine claims to have been told by her community law centre that the statutory warranty restarts with every replacement. That seemed crazy to me because she has had multiple replacements of faulty F&P washing machines every five years or so, and she thinks that if they keep failing then she's going to get an endless supply of washing machines that she will never realise any depreciation on.

 

It would be good if someone could clarify this. I suspect that the community law centre are mistaken, but I am certainly no expert.

If so then stuff like that annoys me. As it just pushes up the cost that appliances have to sell for, to cover CGA related costs.

The ironic thing is that washing machines have only been getting cheaper and cheaper, even with inflation. So not sure if peoples CGA claims are causing prices to go up. I don't think that many people make CGA claims much beyond the normal warranty period.

I was amazed how cheap and how well my LG's work compared to the old crapper I had before. And the dryer uses so much less power than the old F&P without a sensor. That would take 2 hours whereas the condenser one gets most cloths dry enough to hang up in 45 mins.

You may well be right! I have no problem with people seeking a remedy if their original washing machine fails after five years, but if it's 15 or 20 years after the original contract of sale then they're taking the piss in my opinion.

I generally agree it should stop somewhere, but if whichever company is not capable of making a machine that lasts for 5 years maybe you just should have to keep on replacing them until you do.

If you get a complete replacement product, the CGA and all other obligations restart, so if this model breaks every 5 years etc, then so be it.  For a repaired product like mine, then no and my guess is this is why repairs will be the first option.

 

With so many folk paying for extended warranties and repairs rather than claim the CGA, they will get a priority in service as well.

 

While I agree that appliances are cheap considering inflation, manufacturers are using cheaper labour and parts to make.  What does it really say when an appliance only comes with a 1 year warranty.

So Bosch have now offered a replacement machine - more recent model but same or similar specs.  The repaired machine was still problematic and they cannot resolve.

 

So what are my options other than accepting.  Obviously all said and done, if I were a consumer with a choice I would not choose a Bosch in fact, I would likely go back to a top loader as I had one without any issue.  I am also not happy with the length of time they take to service and that they use Able appliances etc etc.

You should now try for a full refund of the original purchase price which would likely be a credit through the retailer. Then you can purchase whatever you want at the same retailer. I am not sure if they must refund / Credit after 3 plus years but you can give it a go. Otherwise a replacement machine with a full new warranty is still a good outcome. Bosch are normally a very good product.
