In short, a number of people snapped up iPads for 1 Flybuy point.

A similar problem to Harvey Norman's 2015 mistake, and I'm sure we'll hear the same bleating about the "requirement" for the deal to be honoured.

Given some have managed to redeem and pick up their iPads from NL before the mistake was picked up it may prove tricky to recover all...

I'll bite.

Why?

Mistakes happen. Why should companies be on the hook for honest mistakes that are usually clearly covered by their terms on websites surrounding mistakes and their discretion on accepting orders.

I don't agree, at least for errors that are obvious like this. But when it comes to a deal that possibly could be valid, but retailers are using bait advertising to sell a loss leader to get people in the store, and don't have adequate quantity, then I would agree. But the stores are possibly breaching the FTA, and can be prosecuted if found to be doing so. But you don't hear of that happening too often, possibly due to lack of resources. Most of the time they just get warnings

Lawyers I have seen who have commented about this type of thing often say that consumers would have to prove that they believe that the advertising was correct. But that is very difficult because they're are often great deals to be had. For example I got 90 percent off the price of an item today, that was on sale. I thought it could be an error, but it wasn't, it was a stock clearance.

Think about this from the point of view of a business owner rather than a greedy consumer. Say it was your business who made the mistake, it came off your profit or out of your bank account. Sure large businesses may be able to absorb some mistakes, but smaller businesses could go under with a simple mistake.

Yes it is so annoying when you go into a Noel Leemings, move a $35.99 price tag from an HDMI cable to a 70" TV and they refuse to honor the price

What cheek these retailers have for not losing money. It's obscene.

Although that doesn't happen these days because the price tag will say the exact model the price applies to.

So what would be the case be if you had done this opened the product and dinged it all the while they are asking for it back , do they want to take back a dinged up iPad that's been opened or would they try and charge the person full value of the product.

Or would they say its not worth the hassle and let you keep it

We didn't used to have these sorts of errors occurring. I wonder what is happening.

I think if they got the items in hand it is theirs to keep regardless of any error. Noel Leeming had plenty of opportunity to fix this before it got to actually collecting goods.

Just my view.

Yes, and the story is saying that they are looking into legal action, if they don't return them. But once they have the ipads, what can they do? Ask them to pay the difference or return them? Anyone knows whow the law works in this sort of thing. I thought that if a store picks up a pricing error after the sale has completed, they can still contact the buyer to say that an error has been made, and to pay the difference. Although this a 'reward' and not strictly a purchase. It is tricky. I do feel for Flybuys on this.

Does the "coupon" list the price (ie. 1 point) or is it more generic than that? Could NL actually tell that there was an error?
