Hi Guys and Gals

 

Hope someone can help out.

 

My son has 3rd party insurance on his car as it is a very old Toyota Camry that is not worth much anyway recently  someone back into his car and caused $900 worth of damage.

 

It was clearly the other drivers fault so he got his details in hope he would sort it out through his insurance

 

It's now been about 3 weeks and he is mostly ignoring my sons phone calls and when he does answer his phone he is making all sorts of excuses about the claim saying his insurance company does not want to know about it as his car was not damaged.

 

A few days ago my son rang his insurance and they contacted the guys insurance and they said he has not made any claim at all so he was lying to my son all along.

 

My sons insurance company also said that if the guy that backed into him does not want do anything about fixing his car or making a claim he does not have to....this seems very unfair.

 

How some people sleep at night I have no idea.

 

Any advise would be appreciated.

Disputes tribunal. Name both the other driver and their insurance company in the claim.

Did not really want to go down that road but I guess if we have to we have to.

 

The guy has full insurance it's no skin off his nose to make a claim also my sons insurance

 

told him that he most properly would not have to pay an excess because his car was not

 

damaged.

Unfortunately there's always a loser when it comes to insurance, and 99 times out of 100 it isn't the insurance company.

Check your policy, some third party policies cover you if you can name the driver and he/she admits fault and has no insurance. As the at fault driver has not made a claim he could be classed as uninsured and your 3rd party insurance might cover the damage. Or it might hurry him to make a claim

Generally when you choose 3rd party, you are also opting out of any advocacy that insurance companies provide when wanting to claim against other parties.

 

$900 is probably more than the other guys excess, so no point in involving insurance. Just pop into the court building, fill in the form for a disputes tribunal and then see if they pay.

Lodge a Police complaint or try the disputes tribunal. Also contact a lawyer.
