Recently had a 3 year old F&P Fridge that failed, where both the retailer and F&P refused to pay repair costs.

I lodged a claim with the disputes tribunal, and now the retailer has come back offering to pay the full repair costs.

While the final outcome is good, the process required to resolve this should have been unnecessary.

Case closed!

Godo to hear they came to the party.

Why don't you update the thread you have already created?

I'm glad you got a satisfactory result, although I do agree that you shouldn't have to jump through so many hoops to get it. Retailers/manufacturers should be well aware of their rights and obligations under the CGA, and should not have to be threatened with the Disputes Tribunal before offering the redress they're legally obliged to give you.

I had a much easier time of it last year, where mentioning the CGA also got me a good result without having to take it as far as you did. My Pioneer A/V receiver started making a humming noise, which got gradually louder the longer it was powered on (to the point where it was distracting from the audio being listened to). It was just over two years old, when I decided to take it to an authorized Pioneer repairer intending to pay for the repairs myself. They charged me $55 to look at it (which would be deducted from the final repair bill).

They rang back a couple of days later and told me that it was going to cost about $400 to fix. Figuring I could get a new receiver for not much more than that, I declined the repair. When I went to pick it up, I asked if they could give me a copy of their findings stating what was wrong with it. They said they can't do that because the repair work was declined by me. When I stated that I wanted the information to try and claim for repair/replacement with the retailer under the CGA, they offered to contact Pioneer directly to see if the repair could be done under warranty. This request was approved, and they even refunded the original $55 to me, meaning the repairs cost me nothing more than my time and petrol money :-)

Yes, but as soon as you update it, it goes to the top again. Also, some people will follow threads, waiting specifically to see what happens. They may miss any new threads you create. Finally, its good for people searching, it means they only need to look in one place. It makes google happy ;)
