also - notice the subtle reference to Telecom (i.e if they do it then so can we)

muuuaaahahahahahahaha! Sorry...I saw it above - it gave me a chuckle - and I just wanted to use it.

I would hazard a guess that you would be put in that pool based on average usage over the past couple of months, rather than purely what you've been downloading during last month.

Then again, I could just be overly optimistic about the lack of BS...

I still don't understand why our personal bandwidth doesn't improve as lots of people leave the pool. Is this a BS factor ?

Do we actually know that lots of people are leaving the pool?  All we've got here on the forum is anecdotal evidence of people leaving - that doesn't necessarily mean a lot of people are.  Also, the people most likely to leave are those with the least invested in it - a.k.a the ones that aren't doing the majority of the downloading.

Oh by the way, after going over all the options today I made the switch to Xnet.  I also rang my bank and told them Woosh had no right to take money from my creditcard.  We'll see how that works out.

As pointed out, those leaving could be those with the least invested (not heavy downloaders)

But also, as people leave, Woosh could also be further shrinking the available bandwidth to the remaining pool, so to maintain the restrictions and make the plan undesirable to all, eventually forcing all to leave Orbit Flatrate.

Quite simply, they dont want people on this plan full stop.

Oh by the way, after going over all the options for the last week, today I too made the switch to Xnet.

I also have closed one of my bank accounts that had the Woosh direct debit coming out. We'll see how that works out.

Well I just paid for another month of Woosh , just for a laugh, and my emailed  invoice says $49.95  now paid for Quickfire Orbit Flat Rate for November . I think they call it Quickfire because getting any bandwidth is a bit of a raffle. Anyway, like Arthur Dent I will lie down in front of my account til  either the world is destroyed to make room for a hyperspace bypass or they come and dig my lines up. ( or i give up and join the xnet circus )

While I understand ya being defiant and determined to get what you paid for, and holding on to the hope of regaining high speeds with unlimited downloads...all ya doing is paying Woosh for a substandard service, and they are fine with you doing that until they finally close the plan for good.

I suppose you could hold out for the Commerce Commision to step in, and maybe your get a simular refund to that of the Telecom Go-Large situation...but Telecom admitted thier fault, and offered voluntarily to refund money, it was not forced. Woosh dont appear to be taking this approach, exactly the opporsite.

Your money, your loss.

I'd have to agree.  This 'problem' is not going to be resolved.  The problem is that Woosh don't want people on thier Orbit Flat Rate Plan.  Once everyone is off it, in thier opinion the problem will be resolved.  Sorry mate, but they ain't gonna give you your old service back.  Remember what happened to Arthur Dent's house? (And planet for that matter).

  Regarding Commerce Commission - I've had a chat to them, nice guy infact, but I got the distinct impression they were a little toothless in this regard.  Woosh is still supplying us with internet, albeit clapped out hunk of crap internet.  If they pulled the plug all together the commission might be more interested.

  As for woosh - when I mentioned what they were doing was a clear breach of the consumers gaurantees act and bought up the commerce commission they practically dared me to try it.  I don't know if that was just a disgruntled customer service rep who was sick of copping abuse over this, or if that is a genuine reflection of Woosh's attitude.

  I'm bracing myself for them to try and charge me a disconection fee, and thinking that maybe the small claims tribunal might be worth a try, though I understand the fee for that is going to be more than I am claiming.  Still might be worth it on principal, or perhaps we could claim as a group?  I've been recording events as they happen incase it does come to this.

Part of the problem with the Comm Comm may be that the Consumer Guarantees Act  is not  serviceable for Business-Business. Therefore if you are a business  in any sense of the word.  (i.e  you claim part or all of your Internet fee on your tax or charge and claim GST), then you are outside of the CGA for any claim. Not many people know this.
