There are two stories here:

1. Corporate cocks up, admits it, and refunds everything - quite a welcome change in behaviour I'd say

2. Corporate offers a product, supplies a different product, customers rippped off

Which one are we likely to see?

Story 2. will run as the headline and first two paras, story 1. will be in the last para which 90% won't get to

I agree with you about cynics

Cynics would be those who for months replied in this forum saying "there's no problem", and then when confronted with the actual facts that there was problem, only look the bright side and say "there was a problem. So what? They admitted it".

I think it's not a media catch. It is a fact that Telecom, through its supporters and CSRs in the first place were trying to convey the message that all was all right, when a lot of their users were here in this same forum saying "Something is wrong, even my browsing is [expletive intended here]".

Well, we have to be careful here... Telecom isn't actually refunding everything. They're only refunding the charges between December 8 and end of February, which is when they say the service was particularly bad.

Then there's the issue of the 60,000 Go Large customers who bought into the service based on the advertising (I think the ComCom is looking into that as a Fair Trading Act issue) and who now found that the terms and conditions have changed substantially.

In other words, the question is: does Telecom's refund offer go far enough?

No Woosh is offering their own service.....i am sure they are not reselling the go large plan.....and some people i know on woosh's orbit flat rate actually get 4mbps speed tests which is quite fair for unlimited data usage for $50 and they do end up downloading 60gb-70gb every month.....

They obviously made a stupid assumption about what people do online when they introduced P2P limiting in the first place. I welcome the non-discriminate rate-limit, it's the only fair way to sell an un-metered plan.

I checked with Telecom Wholesale, and yes, the changes to Go Large apply to the Cabriolet plan as well.

Telecom will credit wholesalers but! it's up to the wholesalers if they refund their customers.

What would you have them do in addition? (genuine question).

I think that its great that Telecom has taken this attitude towards a refund (everyone gets it), and public acknowledgement of issues, when previously, they may have been more well known for asking customers to apply for refunds, and saying that only a few customers have been affected.

This doesnt negate any past wrongdoing (perceived or real), and doesnt make Telecom the best thing since sliced bread. It certainly doesnt excuse the poor service given to 60k customers during the Great Go Large Fiasco Of 2006/7 (GGLFO20067 for short), but I feel it is the right thing for them do.

I havent been through the terms and conditions, but for most services I seem to remember they offer up to one months credit for the affected service, so perhaps at most, it should be a months credit for each billing month during which a faulty service is given.

I also see they have very clearly offered to release customers from contracts, refund modems, and refund install charges, should the customer move to a new ISP.

If Woosh, Telstra or Ihug did all this, then they would probably be hailed as heroes, at the very least, I think Telecom should be acknowledged for taking very positive, very customer friendly / customer centric steps to put this right.

As a Go Large customer who has had serious ups and downs (fantastic speeds and reliability for quite some time, only to degrade into awful/terrible/horrible/intermittent/sometimes-unusable service in the last 3 - 5 weeks), I am quite happy to recieve the refund offered, which certainly (for me) covers the 'bad period' I have had.

I would advise any user who has had a longer 'bad period' to pursue further refunds, dating back to when their issues started.

But its not like there are going to be the equivilent of 'punitive' damages (Voluntarily or otherwise) given out.

I still wish I could get Telstra cable in Hawkes Bay though! Then I wouldnt even need to have an opinion on Go Large!! :-P

That's not really for me to say, but I don't think Telecom's current offer is a bad thing per se - I'm just wondering is if it's enough. Now those 60k customers do not have the service they originally bought into, and I can see that being an issue, especially since we don't at this stage know how the rate-limiting of all traffic will work.

The other part of the offer you mention like refunding modem costs and installation charges weren't mentioned in the official communique we got - is that part of the compensation deal then?

You are right it doesn't go far enough -

To be entitled to the credit offered by Telecom the customer must return all copyrighted materials including music, movies, software, etc that were illegally obtained via the Go Large broadband service to the copyright owner.

things like Skype, Joost, World of Warcraft updates, online games, xbox live are all P2P! the assumption Telecom made, that anything P2P is illegal, is definately an outdated stereotype that won't sit nicely for half a second in the current Internet we live in.
