@KillerHulk:

to be precise , following are the points they mentioned :

"This cover provides for:

1. The sudden and unforeseen accidental damage to the chattel; and

2. The Theft of the Chattel from a secure premises or a secure motor vehicle and for which there is substantiated evidence of a forcible entry into the premises or motor vehicle

Occurring anywhere in New Zealand, unless otherwise excluded."

If this is the only wording of theft in your policy, it requires (the presence of the word  "and") theft from a secure premise or secure MV, followed by the word "and" - means requires evidence of forcible entry.

And in your case not even close to meeting the words on the policy.

Any other wording there?

@trig42:

@KillerHulk:

i told her on the phone,

she is saying there needs to be breakage or something....

This is stupid

Fair Go.

They'd lap this up.

Fair all the go you like, if the wording on signed policy says otherwise ....

frankly until a week after the incident occurred, i didn't knew that i had insurance. i rang my finance company and they notified me about it.

i rang insurance company again, and he specifically said, doesn't matter if you get a hit by a hammer, still not covered.

Also,

i just mentioned what they said and if you guys agree to it then i am ok with it. You guys are more knowledgeable than me in this kind of stuff.

Just so gutted by all this stuff.

The wording of the policy describes the contract you have with the insurer - what is covered and what isn't.

Aka gambling.

You place a bet with insurer saying i'm gonna get my very secure house or very secure car broken into by some real tough nut who really wants to get in instead of mugging the guy in the subway. If it happens, pay me $1000.

Insurance company says - ok, we'll bet $1000 it won't happen, that the thug would rather mug the guy in the subway. If they do, we'll want $100. But you pay first.

Well that sucks, lesson learnt, I'd kick that insurer to the curb though.

If your wife was on shift at the time I'm guessing that Subway (and their insurer) has a duty of care for her and her belongings, it might be worthwhile contacting the Citizens Advice Bureau.
