Handtec seems to be pretty popular on here as well. Pretty quick shipping too. Someone will correct if I'm wrong, but using DHL for shipping makes it quite painless.

Yeah DHL and Fedex have been great for me in the past.
Fedex called me a day before it was even in the country to collect GST so there was no delay etc but you pay to use fedex I think...
DHL are very good too.

We use both at work. FEDEX are head and shoulders above DHL, if you ever get the choice go FEDEX.

Unfortunately the PBT courier that dropped off my FEDEX package didn't ask either my name or for my signature. Not really all that impressed with that... I realise that's a local issue, but you'd hope they'd stick to their procedures a little better than that.

Complain to FEDEX.

Peter Baker Transport seems an unlikely local partner for FEDEX, we get FEDEX themselves here.

Hi All,

So i have just had a live chat with one of the mobicity reps after I saw all this GST issues.

They told me "our product doesn't have GST'

The responses she gave were a bit vague, so I put this question to her

"Put it this way. If customs say they have the phone and wont release it unless GST is paid, will mobicity pay that.

there reply

"No, we will not be. As you could see on the invoice which states that there is NO GST on our handsets as mobicity is not an Australian company"

:/

Also, i swear I saw price included GST. Maybe my mind playing tricks on me, but i cant remember for sure since i ordered on 24th Apr.

Can someone confirm if they saw GST included? otherwise an extra ~$190 ontop of what we already paid mobicity is ridiculous.

I'm 99% sure that the price said incl GST when i clicked on add to cart.

I certainly won't be using them again after this purchase that's for sure.

If Mobicity have ever said GST included then that is misleading/fraudulent.
Clearly if the goods are coming straight from overseas the recipient in New Zealand (importer) has to pay GST.

Otherwise it seems people are presuming that GST is included because they have a .co.nz domain/thought they were a NZ co.

I just cant remember.

Am thinking whether to cancel or not.  An extra $182 is steep. Only thing stopping me is Ive been dragged along step by step with each delay, and to pull out now, all the agonizing wait was for nothing.

Obviously ill need to think fast before it is shipped and too late.

Cancel it now and re-order with Handtec or Clove. Don't touch Mobicity, especially if they are being investigated and decide to pull out of NZ. There is no legal requirement for them to honour our warrantees at all if they do - they're not an NZ company so the Consumer Guarantees ACT does not apply. With increased scrutiny as they've already been reported Customs may even send you a bill for GST on top of what you've already paid, making your delay even longer while it all gets sorted. I'm sure that's the last thing you want.

For peace of mind and a cheaper price, go with someone else.

BLazeD: Assuming I dont want to use Mobicity (I see they aren't shipping anything new for 2 weeks at least anyway), which would be the best site to order an S2 from? Clove seem the most reliable and likely to get more stock the fastest?

Cheers

Clove have a very good name, they are pretty fast, seem to get stock quickly and their customer service is pretty good.
I've ordered two phones, one from unlocked mobiles, one from clove.
I never had a problem with either store and would use either again.

Some people had issues with unlocked mobiles because of their credit checks and lack of info about their credit checks...
I think unlocked are usually a bit cheaper than clove but not a huge difference.

I placed my order with Unlocked Mobile this morning.  And within about 1 minute my bank was on the phone checking that I'd authorised the charge which I thought was pretty quick and decent of them (nice one ANZ).  Hopefully that's all that's needed from the bank to see the order progress without any hiccups.  Stock wont be in until the 16th though.  Hopefully my order nabs one of those phones, their website suggests they'll have plenty of stock from that shipment.

And yes, they were a bit cheaper than Clove.  I think the shipping was marginally cheaper too, and they say the package (sent Royal Mail) will require a signature.

K1000716: In this instance the company, Mobicity, is committing a crime. They are deliberately undervaluing the phone to get it through customs without getting picked up. They are also charging us, the consumers, full price, and are portraying themselves as a company with an NZ presence, which they do not have.  They apparently de-registered as a company in Aussie last year and are probably doing the same thing there.

They are taking our money, charging us the equivalent GST inclusive price, and are pocketing the difference. You'd be better off going with Handtec and Clove and taking the chance that your package might not get picked up for GST - it'll still be cheaper in the long run.

I'm a bit annoyed as I placed my pre-order with them because I wanted to use a company with a presence here. Instead I've paid an inflated price (they've pocketed their normal profit + the GST equivalent) and help them boost their profits, while they've happily committed fraud. I doubt much can be done to them as they have nothing in NZ, but I know I'll never use them again.

It is different to the hit and miss method, as the company sending it is doing the right thing (full value listed). If it doesn't get picked up the so be it, it was sent correctly and not picked up by customs, the consumer pockets the difference. If the company deliberately mislabels the package ($200 Smasung S5230) that is clearly fraud, and they pocket the extra money - ripping off both the customer and customs.

So many things to respond to K1000716. Where to start? You are obviously a highly moral person.

GST:
My comment was specifically addressed at the previous poster's claim that the country was being disadvantaged. It isn't, as the sender isn't liable for any excise/tarriff, the recipient is. The GST remains in this country. If the recipient has the moral courage of course, he is entitled to point out the GST shorfall and offer to make it up

That would be a very noble thing to do. Would you do it?

The money you pay by personally importing is almost invariably less than you you'd pay buying it here, and thus even when you pay the full whack, you're contributing less GST than you would if you bought from a regular retailer or carrier here. Does that worry you?

Does it bother you that whenever retailers deeply discount their goods here, the GST return to the govt is less? I'm sure it doesn't. You, the buyer, benefit at the goverment's expense. The shortfall of GST at the border pales into utter insignificance compared to the fluctuations that occur every day in the normal course of commerce. Getting one's knickers in a twist about the GST shortfall at the border seems to be an overreaction to me.

Being ripped off:
If you were in fact paying the GST inclusive price to the sender, then you'd be entitled to that VAT rebated to you since their VAT is also an internal consumption tax and the product was exported. Assuming you actually paid the GST/VAT as you suggest, did you claim the rebate? If not, perhaps you could look into it. Or if you paid GST on the VAT inclusive price here, then surely you'd be entitled to have Customs look into that as an alternative?.

Fraud:
If Mobicity are commiting fraud, then that's probably an issue for the Dept of Trade to sort out with the country of domicile of the company perpetrating the fraud. I'm pretty sure that NZ Customs have this stuff way down their list of priorities compared to say, drugs and terrorism.

If you want to be outraged by this, then that's your priviledge. Personally, I'd say Customs have better things to do with their time and I'd sooner they concentrated on stuff that, in my perspective at least, is likely to deliver a greater benefit to us all.

I know that I wouldn't be happy with a company that mis-represented itself so getting the word out to potential customers about shady practices is a healthy thing. So this thread will serve a useful purpose, no matter where you stand. And although I disagree with much of your reasoning, your heart's obviously in the right place.

Cheers,
R2D2
